Religious discrimination: Youth to appeal against anticipatory bail granted to 3 employees of Diamond Company

Mumbai: Zeeshan Ali Khan, an MBA graduate from Mumbai who filed the case has decided to approach Bombay High Court against the anticipatory bail granted to three personnel of leading Diamond Company Hari Krishna Export limited by Mumbai Session court.

Khan was denied job by the Diamond company on June 19 citing religious ground that created furore in the media. He has filed a case under section 153 A of IPC against the company for hurting his religious sentiments and or discrimination on the bases of religion.

Mumbai session Judge Sharma on Wednesday granted anticipatory bail to Dipika Tike, Bhaskar Joshi and Mahindra Deshmukh.

The accused had contended that the mail was sent erroneously and superiors were unaware of the kind of reply sent by the Tike, who the company says was the trainee. Joshi argued that an apology was immediately issued to Khan for the controversial mail received by him from the company.

Two other directors of the company viz. Ghanshyam Dholakia and Hasmukh Dholakia withdrew their bail applications saying that they believe the case is not made out against them and hence they need not fear of arrest in the case.

However, the lawyer of Khan believes that police are shielding them and might have assured them of not arresting and hence their lawyer withdrew bail applications.

“First both the directors approached court for anticipatory (bail) and then suddenly withdrew application. The withdrawal of their application give us the sense of their understanding with the investigative police”, said Advocate Khalid Azmi, who is representing Khan before court.

When asked what will be the appellant’s next course of action, he said, “We shall continue to maintain pressure on police for investigation in the case and will approach Bombay high court for the arrest of Dholkia duo and to cancel anticipatory (bail) of other three”.
