7/11 Mumbai blasts: Convicts’ lawyers brief discrepancies in case to Owaisi urging to raise matter in parliament

Mumbai/Hyderabad: Aggrieved with the conviction and sentencing of 12 youths by special MCOC court in 7/11 Mumbai serial blasts case, defense lawyers of accused have met All India Majlis-Ittehadul-Muslimeen (AIMIM) chief Asaduddin Owaisi in Hyderbad and explained him “all factual and technical discrepancies in the case that were overlooked by court”.

Advocate Abdul Wahab Khan and his juniors met Owaisi at his office on Saturday and briefed him about the whole case along with the “set of strong evidences proving all accused in the case as innocent that were suppressed before the eyes of court by prosecution in the presence of false, fabricated and cooked up evidences brought up by Anti Terrorist squad (ATS) in the case.”

Khan urged Owaisi to raise the issue in the Parliament and explain “how injustice is being done with convicted men as well as victims of the blasts as real culprits in the case have never been prosecuted by investigation agency and state.”

Speaking with TwoCircles.net Advocate Afzal Jameel, junior of Khan said, “Owaisi sahib listened to our briefing curiously and asked for documentary proofs proving accused innocent. We explained to him all the discrepancies and how ATS implicated accused in the case and how state government backed its false theory even after another agency gave clean chit to these accused couple of years after ATS filed charge sheet”.

In September 2008 Mumbai crime branch arrested alleged Indian Mujahideen accused persons who had confessed before magistrate their role in 7/11 train blasts but they were not charged in the case by ATS.

Defence lawyers of accused claim they were not arrested in the case by ATS because charging them in the case would have meant earlier arrested 13 men were innocent and also their filed charge sheets would have been contradicted.

“We also pointed out to him (Owaisi) how some ATS officers did not want these accused to be falsely implicated in the case and one of the officer had even written to President of India telling wrong investigation has been done in the case by ATS”, Jameel added.

Jameel says, they informed Owaisi about these factual discrepancies, and also briefed him on technical faults in the case that the court did not pay attention to while judging the evidences to reach logical conclusion.

According to Jameel, after giving patient hearing, Owaisi told lawyers he will once go through the arguments provided to him and will apprise parliament about the injustice that has been done in the case due to misguided investigation of ATS.

On September 30, MCOC court sentenced 5 to death and 7 to life imprisonment.

Asif Khan, Ehtesham Kutubuddin Siddiqui, Naveed Hussain Khan, Kamal Ahmed Mohammed Vakil Ansari and Mohammed Faisal Ataur Rahman Shaikh are sentenced to death while Dr Tanveer Ahmed Mohammed Ibrahim Ansari, Mohammed Majid Mohammed Shafi, Shaikh Mohammed Ali Alam Shaikh, Mohammed Sajid Margub Ansari, Muzammil Ataur Rahman Shaikh, Sohail Mehmood Shaikh, Zameer Ahmed Latifur Rehman Shaikh and Rasheed Hussain Khan are sentenced to life.
