Fresh Triple Talaq Bill to be the first bill to be introduced in the 17th Lok Sabha

The union cabinet, today, has approved the fresh bill banning triple talaq or the instant divorce practise. The bill will replace the ordinance that was passed by the same Government – UPA led BJP but had lapsed with the dissolution of the previous Lok sabha as it was pending in the Rajya Sabha.

The bill will most likely be introduced on 17th June in the first sitting of the budget session.

The bill, introduced earlier, sought to criminalise the divorce procedure of triple talaq and claimed to protect the rights of the married Muslim woman by imprisoning the man for a period of three years. However the opposition had argued that this law can be misused and to ensure that it is not misused another provision was added enabling the husband to apply for bail that can be granted only by a magistrate.

A Magistrate  has the power to grant bail in non-bailable offences, so the accused can submit his bail petition to the Magistrate even before his trial for talaq-e-biddat ( instant divorce) begins.

The newly formed government plans to convert the ordinance into law according to which instant divorce will be unlawful and void. And the Husband who has given divorce through the triple talaq process will be jailed for 3 years.
