    Will the Minister of CIVIL AVIATION be pleased to state:-

    (a) whether the Government is aware of the recent incident where an air hostess was allegedly assaulted in an Air India flight;

    (b) if so, the details thereof and the number of such incidents reported during the last three years;

    (c) whether the National Commission for Women(NCW) is looking into the issue; and

    (d) if so, the details thereof and the action taken by the Government to prevent the recurrence of such incidents in future?

    (a) and (b): Yes, Sir. On arrival of Flight No. IC 884 of 3.10.2009, one of the Cabin Crew made a log entry dated 3.10.2009 in the Movement Control Log Book, stating that the Commander and the Co-Pilot of that flight had mentally and physically assaulted both herself and one other Cabin Crew of that flight.

    No other case of assault of Cabin Crew on Board has been reported in the last three years.

    (c) and (d): Yes, Sir. National Commission for Women is conducting an independent enquiry and, so far, no report has been received from the Commission.

    STATEMENT REFERRED TO IN REPLY TO THE LOK SABHA STARRED QUESTIONO NO.38 RAISED BY SHRI SYED SHAHNAWAZ HUSSAIN AND SHRI SANJAY SINGH CHAUHAN REGARDING ‘NEW TAX CODE’

    (a) The salient features of the new Direct Tax Code are as under:

    # The proposed new Direct Tax Code will replace the Income-tax Act, 1961 and is not an amendment of the existing law.

    # All the Direct Taxes (i.e. Income Tax and Wealth Tax) have been brought under a single code and the compliance procedure is unified.

    # It has been drafted in simple language which will convey with clarity, the intent, scope and amplitude of the provisions of the law. It will facilitate voluntary compliance from the tax payers.

    # It would avoid ambiguity in interpretation and thus the scope of litigation will be minimized.

    # It has been structured in a manner which is capable of accommodating changes according to the needs of a growing economy without resorting to frequent amendments.

    # The new tax code seeks to eliminate exemptions and deductions so that the taxing statute can be better administered. This has significantly contributed to the simplification exercise.

    # It seeks to provide stability in tax rates.

    (b) The indicative tax rates and tax base in the code have been proposed with an objective to achieve more or less the existing level of revenues.

    (c) to (e) Yes Sir. Government has invited opinion from public by releasing the draft proposals on Direct Taxes Code on the Ministry of Finance’s website [email protected]. Further, Finance Minister and Senior Officials from Ministry of Finance have participated in a number of seminars and had interaction with a numbers of stakeholders. Their suggestions have been received and are being examined by the Government before finalizing the draft bill.

    (a), (b) & (c) Based on the data available in MCA-21, Government have identified a set of risk factors to generate alerts about serious non-compliances or unusual state of affairs of a company.These alerts relates to related party transactions, non-payment of deposits, etc. The Registrars of Companies and the regional directorates, have been involved in this exercise.

    (d) Strengthening of MCA-21 System is an on-going exercise and steps are taken on regular basis to update and modify the system according to requirements.

    Subject: NATIONAL RURAL HEALTH MISSION

    Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:-

    (a) whether irregularities have been noticed in the implementation of National Rural Health Mission (NRHM);

    (b) if so, the details thereof, State/UT-wise;

    (c) the corrective steps taken and proposed to be taken in this regard;

    ANSWER

    THE MINISTER OF HEALTH & FAMILY WELFARE(SHRI GHULAM NABI AZAD)

    (a) to (e) The National Rural Health Mission (NRHM) is being implemented since April 2005. The NRHM seeks to undertake comprehensive reforms in health sector in partnership with states and improve health care services in the entire country with special focus on primary health care in rural areas.

    The Government has operationalised a multipronged monitoring protocol to check for any irregularities in the implementation of NRHM. As part of this protocol, regular web based Management Information System (MIS), regular state review visits, periodic surveys, community reports are collated to check for areas of improvement in the implementation of NRHM. The corrective steps, if any, are appraised & approved as part of the Annual Programme Implementation Plans (PIP) of respective states.

    The Planning Commission has undertaken periodic evaluations of NRHM in the past and concurrent evaluation of NRHM is presently underway in selected states. An evaluation study was carried out in states of AP, UP, Rajasthan, Bihar where it was noted that the progress across the states is uneven and different states were performing differently on various parameters. The study noted that the institutional framework of NRHM was in place and hope has been generated for rural health infrastructure in the country.

    (a) & (b) As per the National Crime Record Bureau (NCRB), total of 86, 125, 96 and 122 cases were reported in the country during 2005, 2006 2007 and 2008 respectively.

    (c) & (d) To make the implementation of the Act more effective and stringent, amendments were discussed in the 16th meeting of the Central Supervisory Board, which included enhancement of punishment under the Act.

    THE MINISTER OF HEALTH AND FAMILY WELFARE(SHRI GHULAM NABI AZAD)

    (a): The States/UTs are given funds under Mission Flexi Pool under National Rural Health Mission (NRHM) and RCH Flexi Pool for implementation of various national level health programmes of the Government of India which form part of annual Programme Implementation Plan (PIP) of a State. Information, Education and Communication (IEC) is an approved and on going activity under all programmes including the National Disease Control Programmes. The activity has definite and planned strategy at central, State and district level to create awareness about health problems among the target population. The States take up IEC activities as per the programme needs. Apart from this, the ministry also carries out various general and innovative IEC campaigns through multi media tools, exhibitions, health melas, workshops, by celebrating special health days like World Health Day etc.

    The Department of AIDS Control have also taken up vigorous campaigns to create awareness on HIV/AIDS and to promote safe behaviours. Department of AYUSH have also launched campaigns for improving health seeking behaviour of people in Ayurveda and Homoeopathy etc. The achievements of IEC campaigns cannot be gauged in quantifiable terms. However, its impact is visible on the masses. National Rural Health Mission has been well positioned through length and breadth of the country through sustained IEC campaigns.

    (b) & (c): A special focus is being given on 18 Sates namely, Bihar, Jharkhand, Madhya Pradesh, Chhattisgarh, Uttar Pradesh, Uttarakhand, Orissa, Rajasthan, Himachal Pradesh, Jammu & Kashmir and eight States in the north-east under the National Rural Health Mission.

    (d): IEC campaigns are formulated and modified from time to time keeping view the target audience under a particular health programme. Even the services of professional agencies in the field are also availed in this regard.

    MINISTER OF STATE FOR COMMUNICATIONS AND INFORMATION TECHNOLOGY (SHRI SACHIN PILOT)

    (a): There is no official estimate available to indicate the extent of software piracy and losses due to such piracy in India. However, it is believed that piracy in software industry exists as in other copyright based industry.

    (b): For checking piracy effectively, certain major amendments in the copyright Act were carried out in the year 1994. These amendment provide for simplification of certain concepts and rights, enhancement of penal provisions and collective administration. The Government has also set up a Copyright Enforcement Advisory Council, including representatives of leading copyright agencies and organizations, to review the progress of enforcement of the Copyright Act periodically and advise the Government regarding measures on policy and implementation for improving the enforcement of the Act. Government agencies, NASSCOM officials, police and various other law enforcement agencies are committed to enforce copyright laws and eradicate the menace of software piracy. Further, instructions have been issued to various Government Departments to only use legal copies of software.

    (a) whether the law and order situation has deteriorated in the North- Eastern States including in the North-Eastern states including in the North Cacher Hills district of Assam;

    (b) if so, the details thereof alongwith the reasons therefor and the details of such cases reported during each of the last three years and the current year, State-wise;

    (c) whether any Central team has been sent to assess the situation in the States;

    (d) if so, the details of the findings of the team and action taken thereon; and

    (e) the details of the insurgent groups operational in the said regions and names of those organisations which have been banned, alongwith reports of foreign assistance being provided to such groups and action taken against them?

    MINISTER OF THE STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)

    (a) & (b): The security situation in the North Eastern States centers around a number of issue such as language/ethnicity, inter-tribal clashes, migration, control over local resources and a wide spread feeling of exploitation and alienation. This has resulted in violence and diverse demands by various outfits. A statement showing security situation in the North Eastern States during the last three years upto 15.11.2009 is given in the Annexure. The security situation in the worst affected States are reviewed both in Delhi and in the State Capitals.

    (c) & (d): A Central team led by Special Secretary (Internal Security) in the Ministry of Home Affairs visited Guwahati and NC Hills District of Assam on 26-27 May, 2009 to review the security situation with State Government officials, Central Police Forces and Army. The team also met Chief Minister, Assam during their visit to Guwahati. A number of security measures were suggested by the team to contain the violence of DHD(J). The Union Home Secretary also reviewed the security situation in NC Hills district during his visit to Assam on 30 July 2009. Sustained CI operations was launched by the Security Forces against DHD(J). The Chairman of DHD(J) and his two associates were arrested on 4.6.2009 at Bangalore. Due to sustained CI operations by the Security Forces and State Police in NC hills District, DHD(J) had surrendered their arms on 2.10.2009. No incident of violence by DHD(J) has been reported since September 15, 2009 in NC Hills district of Assam. Security situation was reviewed by the Union Home Minister during his visit to Nagaland and Manipur on 3rd February, 2009. Cabinet Secretary had also reviewed the situation during his visit to Assam, Nagaland and Arunachal Pradesh on 7-8 April, 2009. The meeting was also attended by Union Home Secretary and Defence Secretary. Union Home Secretary during his visit to Manipur on 23-24 August, 2009 reviewed the situation in the State. Further Union Home Secretary reviewed the security situation in Nagaland during his visit to the State in October, 2009.

    (e): A number of militant outfits have been operating in North Eastern States. United Liberation Front of Asom (ULFA), National Front of Bodoland (NDFB), Dima Halam Daogah (Joel Group) DHD(J) in Assam, People’s Liberation Army (PLA), United National Liberation Front (UNLF), People’s Revolutionary Party of Kangleipak (PREPAK), Kanglei Yaol Kanba Lup (KYKL), Manipur People’s Liberation Front (MPLF), Revolutionary People’s Front (RPF) in Manipur, All Tripura Tiger Force (ATTF), National Liberation Front of Tripura (NLFT) in Tripura and Hynniewtrep National Liberation Council (HNLC) in Meghalaya have been banned under the Unlawful Association (Prevention), Act, 1967. As per reports, some of the outfits have been provided logistic support by the Pak ISI. The Government has pursued a coordinated multi-pronged approach against insurgency which includes strengthening the border management to check infiltration, galvanizing the intelligence machinery, improved technology, weaponry and equipments for security forces both at the Centre and in the States, neutralizing plans of terrorist groups by well coordinated intelligence based operations.

    (d) whether all the States and the private sector have also been asked to share the cost of fullfilling the commitment under the Act;

    (f) whether the Government plans to bring Sarva Shiksha Abhiyan(SSA) under the Act;

    (g) if so, the details thereof; and

    (h) the steps taken or being taken by the Union Government to implement the Act?

    (a): The Right of Children to Free and Compulsory Education (RTE) Act, 2009 inter alia provides for the:

    i) Responsibility of the Central and State Governments and local authorities for free and compulsory elementary education to all children in the age group of six to fourteen years.

    ii) Prescribed norms and standards relating to infrastructure, pupil- teacher ratios and other quality parameters.

    iii) Minimum qualifications for a person to be eligible for appointment as a teacher.

    iv) Curriculum and evaluation procedure conforming to values enshrined in the Constitution.

    v) School Management Committees to monitor the working of the school;

    vi) Mechanism for the protection of the rights of the child under the Act

    (b): Government of India releases under Sarva Shiksha Abhiyan (SSA) & District Primary Education Project (DPEP) during the last three years and the current year for each State is given in Annexure I and II.

    (c) to (e): The National University for Educational Planning and Administration (NUEPA) has, at the instance of the Government, prepared estimates for additional requirement of funds for a 5-year period from 2010-11 to 2014-15 for the implementation of the provisions of the RTE Act, which works out to Rs 1,71,484 crore. The RTE Act provides that the Central Government and the State Governments shall have concurrent responsibility for providing funds for implementation of the Act. Under the Act unaided schools are required to admit at least 25 per cent children belonging to disadvantaged groups and weaker sections from the neighbourhood in Class I and provide them free elementary education. The expenditure so incurred will be reimbursed to the extent of the per-child expenditure incurred by the State, or the actual amount charged from the child, whichever is less.

    (f) & (g): A Committee on Harmonization of SSA with the RTE Act has been set up to examine the overall approach and implementation strategies under SSA and align the SSA vision, strategies and norms with the RTE mandate. The Committee has held five meetings and met with representatives of almost all the States during the course of its deliberations. The Report of the Committee is awaited.

    (h): The Government has initiated several steps for implementation of the RTE Act, including preparation of financial estimates, consultations with State Governments and Civil Society Organisations, and preparation of ‘Model’ Rules under the Act.

    (a) & (b) World Health Organization has observed that the pandemic flu vaccine may not be available in time for the winter surge. The observation is based on the fact that the pandemic vaccine manufacturing capacity is limited.

    (c) to (e): Government of India constituted a Committee under Secretary (Health Research) to address this issue. Regular meetings were held with potential Indian manufacturers and with those external sources from which vaccine can be imported.

    Ministry of Health and Family Welfare is working on a two step strategy. Development of pandemic vaccine by indigenous manufacturers is being encouraged. Three companies (Serum Institute, Pune; Panacea Biotech; Gurgaon and Bharat Biotech, Hyderabad) are working towards this and it is expected that clinical trials would start in January 2010. If all goes well, indigenous vaccine would be available by June 2010.

    To cover the interim period, Government of India is importing four million doses of Pandemic vaccine to vaccinate the high risk group. This vaccine would be available by December 2009.

    (b): The study of the outcome of these States is yet to be initiated.

    (c) & (d): With a view to providing death and disability cover to rural landless households, the ‘Aam Aadmi Bima Yojana’ has been launched on 2nd October, 2007. Under the scheme, the head of the family or one earning member in the family is insured. The Central Government bears 50% of the premium of Rs. 200 per year per person and the remaining 50% of the premium is borne by State Government. The benefits under the scheme include Rs.30,000 in case of natural death; Rs.75,000 in case of death due to accident or total permanent disability due to accident. In case of partial disability due to accident, the insurance cover is Rs. 37,500 The children of beneficiaries of AABY studying in classes 9th to 12th standard are eligible to a scholarship @ Rs.300 per quarter per child.     A total number of 17 HPT-32 aircraft have crashed till date and 19 pilots have lost their lives in these accidents. The total loss suffered as a result of these accidents amounts to Rs. 16,21,35,054/-. Each crash of Defence aircraft is investigated through a Court of Inquiry and remedial measures are undertaken accordingly.

    (a) & (b) Yes, Sir. So far as Electronic Media (Private Television) is concerned, all programmes and advertisements telecast on TV channels, transmitted/retransmitted through the Cable TV network, are required to adhere to the Programme and Advertising Codes prescribed under the Cable TV Networks (Regulation) Act, 1995 and rules framed thereunder. Action is taken as per rules whenever any violation of Code is brought to the notice of the Government. This Ministry has constituted an Inter Ministerial Committee (IMC) to look into the specific complaints or suo motu take cognizance against the violation of Programme and Advertising codes and action is taken as per rules if violation is established. Government has also set up an Electronic Media Monitoring Centre (EMMC) to monitor the content of private television channels with reference to the violation of Programme and Advertising Codes.

    As regards Print Media, the Government has set up the Press Council of India (PCI) which is a statutory autonomous body under the Press Council of India Act, 1978 with the twin objectives of preserving the freedom of the press and of maintaining and improving the standards of newspapers and news agencies in India and to inculcate principles of self- regulation among the press. The Government does not exercise any control over the content of print media. However, the Press Council monitors and takes cognizance, suo motu or on complaints, of advertisements, which it is prima facie satisfied, are violative of the ethics of journalistic practice. Accordingly Press Council of India, in order to prevail upon the Press to practice self-regulation has been issuing directions/appeals to newspapers/magazines to guide them in publication of advertisements etc. The Press Council of India has formed Norms of Journalistic Conduct under Article 13(2) (b) of the Press Council Act 1978.

    (c) & (d) As reported by Advertising Standards Council of India (ASCI) complaints of violation of ASCI’s code by electronic and print media have been received by them during last three years. A statement showing the number of complaints received by ASCI and details of action taken thereon is annexed.

    (e) Action is taken against the TV channels whenever any violation of Advertising Code comes to notice. Similarly, Press Council of India also issues notices/directions to newspapers/magazines only.     142.64 lakh tons of wheat is stored in open (Cover and Plinth) with FCI and State agencies in Punjab and Haryana.

    To augment the storage capacity, FCI is likely to create 1.39 lakh tons additional storage capacity during the 11th Five Year Plan 2007-12. FCI has also proposed to create additional storage capacity of about 126.35 lakh tons through private sector participation in various States for TPDS requirements.

    Besides, the following steps have been taken by F.C.I. for safe storage and preservation of foodgrains in covered godowns and cover and plinth (CAP) complexes:

    (i) All FCI godowns are constructed as per specifications.

    (ii) Foodgrains are stored by adopting proper scientific code of storage practices of the foodgrains.

    (iii) Adequate dunnage materials, such as, wooden crates, bamboo mats, polythene sheets are used to check the migration of moisture from the floor.

    (iv) Fumigation covers, nylon ropes, nets and insecticides for control of stored grain insect pests are provided in all the godowns.

    (v) Prophylactic (spraying of insecticides) and curative treatments (fumigation) are carried out regularly and timely in FCI godowns for the control of stored grain insect pests.

    (vi) Effective rat control measures, both in covered godowns as well as in CAP storage are used.

    (vii) Foodgrains in CAP storage are stored on elevated plinths and wooden crates are used as dunnage material. Stacks are properly covered with specifically fabricated low-density black polythene water proof covers and tied with nylon ropes/nets.

    (viii) Regular periodic inspections of the stocks/godowns are undertaken by qualified and trained staff of FCI including senior officers.

    (a)&(b): The Performance Audit by Directorate General Audit Central Revenues (DGACR) for the period 2006-07 observed that the procurement process by the Institute did not ensure sufficient competition and was marred with irregularities. The purchases were made without proper assessment of actual requirements.DNA Sequencer purchased in June 2006 for Rs. 1.02 crore and 7 other moveable equipment purchased in 2006 were found to be unutilized.

    (c)to (e) : Government instituted fact finding committees following which the then Director was removed and formal departmental disciplinary proceedings were initiated against him. He has also since been repatriated to his parent organisation.A number of corrective measures have been taken to improve the working in the institute. Further, regular meetings of the Governing Body and the Standing Finance Committee are held to monitor/oversee the functioning of the Institute.Procurement of equipment after assessment of requirements is now made through a procurement agency following Government guidelines.

    (a) & (b) : The Government has operationalised a multipronged monitoring protocol to assess the performance of health services being provided to the people and the architectural corrections being operationalised under the National Rural Health Mission (NRHM). As part of this protocol, regular web based Management Information System (MIS), regular state review visits, periodic surveys, community reports, etc are collated to check for desirable areas of improvement in the delivery of health services. The corrective steps, if any, are appraised & approved as part of the Annual Programme Implementation Plans (PIP) of respective States.The corrective measures include steps required to address shortages of infrastructure, human resources, technical skills, logistics and supply chain management, training and other aspects of the health delivery system.

    (a) & (b): The Plan wise growth in population is not available from Population Census. However, as per Population Census, the average annual growth rate in population during the decade 1991 to 2001 was 2.15%. The average annual growth rates in foodgrains production during the ninth and tenth plan periods have been 1.46% and 1.29% respectively.

    To a large extent, the production of foodgrains is affected by the natural factors such as rainfall situation, weather conditions, natural calamities like drought/flood etc.

    (c): The plan wise details of per capita of foodgrains is not available. However, as per reports of the Consumer Expenditure Surveys 1999-2000 (55th Round) and 2004-05 (61st Round) conducted by the National Sample Survey Organisation (NSSO), the monthly per capita consumption of foodgrains in India are given below:-

    (c) & (d): 94.06 lakh was under cotton in 2008-09 (IVth Advance Estimates). Of this 60.77 lakh was under Bt. Cotton. Bt. Cotton seed was supplied by private sector. 17.5% of Non-Bt. Cotton seed against requirement was available in public sector as per information provided by States.
