New Delhi:The Delhi High Court Thursday issued warrants against senior engineers of the Municipal Corporation of Delhi (MCD) for misleading the court by telling it that unauthorised constructions had been demolished even when they had not taken any such step.
Taking strong exception, Justice S.N.Dhingra issued bailable warrants against the engineers (Maintenance) & (Building) to ensure their presence in court to answer why they should not be punished for contempt of court. They have been asked to appear by Feb 10.
“It has become a practice to give false representation to the court of taking action against the unauthorised constructions in the name of action taken,” the court said in its order.
Citing how the MCD is making a “mockery” of the entire drive, the court said: “A small portion of the unauthorised construction is first demolished by the MCD, leaving it to the party to repair it, and then a report will be submitted to the court that action has been taken. The party which was affected gets it repaired. In this scenario, everybody is enjoying the fruit of unauthorised construction in the capital.”
Holding the MCD engineers responsible for contempt of court, the bench said: “MCD officers had not taken any action and it is a gross contempt of the court that the MCD officers, without taking actual action, told the MCD counsel that action has been taken and his statement was recorded in the court.”
