Court takes note of graft charges against excise official

New Delhi : A special CBI court here Thursday took cognizance of a charge sheet filed against an official of the central excise and others, and paved the way for their trial in a graft case.

Central Bureau of Investigation (CBI) Special Judge Talwant Singh took cognizance of the offence alleged against central excise Superintendent Lallan Ojha and middleman Hemant Gandhi and two other businessmen.

“I have gone through the charge sheet and the documents. I find sufficient material to take cognizance of the offence under section 7, 13(2) read with 13(1)(d) of the Prevention of Corruption Act and under section 120 B of the IPC (Indian penal Code) against Lallan Ojha, Hemant Gandhi, Dilip Aggarwal and Anand Aggarwal,” said Judge Singh.

The court issued summons to businessmen Dilip Aggarwal and Anand Aggarwal and production warrant against Ojha and Gandhi, lodged in the Tihar Jail.

The court, however, did not take cognizance of charges against Central Excise Commissioner A.K. Srivastava as the sanction from the concerned authority to prosecute him was still awaited.

According to the CBI, Ojha along with a team of officials of central excise, conducted a surprise raid at the warehouse of Dilip Aggarwal and Anand Aggarwal and negotiated a deal for illegal gratification.
