Solapur (Maharashtra): In a recent development, Mahmooda Bi, mother of Khalid Machala who was killed in Bhopal encounter on Monday, has lodged a complaint here at MIDC police station and sought prosecution of Bhupendra Singh, Home Minister of Madhya Pradesh and five other high profile police officials.
Amid high drama, Mahmooda Bi today went to MIDC police station along with around 500 people and demanded the filing of an FIR. She was also accompanied a team of lawyers and Hafiz Nadeem Siddique, President of Jamiat Ulema-e-Maharashtra.
In a complaint letter, she claimed that the murder of her son was a well “hatched up conspiracy” and thus demanded for registration of an FIR u/s 120 (B), 302 and 201 of I.P.C against Bhupendra Singh, Yogesh Chaudhary, IG Bhopal; Rishi Kumar Shukla, DG Madhya Pradesh; Arvind Saxena, SP Bhopal; Akhilesh Tomar, Superintendent of Central Prison Bhopal and Sanjeev Shami, Chief of ATS, Madhya Pradesh.
“His killing was claimed as an “encounter” whereas it is neither possible nor feasible by any stretch of an imagination. There was no occasion or reason for my son to escape from the prison as the entire family, including him, were confident and assured about his innocence,” she wrote in her complaint.
She stressed that her son had full faith in judiciary and law of the land. “It is clearly a cold-blooded murder which was well designed and executed in accordance and furtherance of their conspiracy”, she alleged in the complaint.
Demanding action, she wrote, “In the interest of justice, it is very much necessary to investigate the matter in depth regarding the brutal murder and conspiracy hatched up by the above-named high profile office bearers and all other concerned persons who have facilitated in the killing of my unarmed son, who was in judicial custody.”
She has also sent a copy to Chief Justice of India, Chief Justice of Bombay High Court, Chief Justice of Jabalpur High Court, Home Secretary of Maharashtra and Home Secretary of MP.
Kalyanrao Patil, a senior police inspector refused to file an FIR, but after three hours of hue and cry, the gathering of people met Ravindra Sengaoukar, Commissioner of Solapur who agreed to register the complaint in a station diary, which the MIDC police station shall forward to Bhopal police for further action.
“We wanted to register an FIR but they have not registered it. However, they have registered the complaint. Our legal team shall now decide about the next course of action so that justice can be given to our deceased client’s mother, widow and four children”, Advocate Wahid, associate of Advocate Tahiwar Khan told TwoCircles.net.
Advocate Tahiwar Khan said that he has got the authority letter from Mahmooda and that his legal team will try their best to get justice for Khalid’s soul through legal procedure.
“We strongly believe in “Satyameva Jayate” (Truth alone triumphs) and have full faith in our country’s judiciary. We will continue our legal battle to get justice for Mahmooda and the four undertrial accused from Solapur who were implicated by the ATS in Bhopal case”, he added.
