Letters to NHRC, NCM, Women Commission, UP Chief Sec, Amnesty urging actions against those involved in sexual assault

    Muzaffarnagar/New Delhi: Advocate Naushad Ahmad Khan, who hails from Muzaffarnagar but practices in the Supreme Court, has written comprehensive letters to the chief secretary of UP, National Commission of Minorities, National Human Rights Commission, National Commission for Women, Press Council of India, Amnesty International and other such bodies urging them to recommend actions against those involved in sexual assaults of women in Muzaffarnagar riots.

    This is the second letter Khan has sent to those authorities and institutions, urging them to recommend to the appropriate authority to arrest the accused persons of gang rapes, to conduct MLC, to record statement under section 161 and 164 Cr.PC., to record the statements of threats and to provide security and justice.



    He highlighted that even in all registered cases of rapes or gang rapes, no accused person has been arrested so far though the names of all persons have been disclosed in the FIRs. They have been identified and recognized being neighbours and from the same village, he added.

    The accused persons are regularly threatening the victims and the witnesses and threatening calls are being made to them. Because of the callous and collusive approach of the local administration, local Pradhans and influential persons, and threats a large number of victims are not coming forward for complaints and depositions, Advocate Khan said.



    He has urged them to recommend proper security of victims, speedy actions, arrests of accused persons, rehabilitation of the victims of sexual assault at the very first priority and to provide them with medical facilities and shelter.

    He also urged that prompt actions should be taken against those who are responsible for making threatening calls and pressuring the victims and their family members for withdrawal of cases.



    The petitioner has attached a list of approximately 43 accused persons carved out from the First Information Reports, pressing for urgent and immediate action by the investigating agencies to arrest the culprits and to restore the confidence and sense of security to the victims so that they can freely depose before the investigating officers.

    As case studies, Advocate has also enclosed certain reports and audio-video recording of some of the gang rape victims exposing one particular village Fugana whereas as of now 6 gang rape cases have been reported.

    Pointing to the false cases being filed against the riot victims, Advocate Naushad Ahmad Khan told TCN, “It is ironical that and total farce that the same persons who have been made accused in serious charges of murder and rape, are now going to police station and filing counter fabricated FIRs of false cases of burning property and crops, and instead of arresting them when they go to PS, cops are registering fabricated cases.” He pointed out that most of the victims are in camps, and that such cases are being filed to put undue pressure on them.

    Meanwhile a team of National Human Rights Commission headed by Mr. Justice Cyriac Joseph, Member and comprising Mrs. Kanwaljit Deol, Director General (Investigation), Mr. A.K. Garg, Registrar (Law), Mr. C.K. Tyagi, Presenting Officer, Mr. S.K. Jain, SSP and Shri Nitin Kumar, Inspector are visiting Muzaffarnagar and Shamli Districts of Uttar Pradesh on two day mission.
