‘GSM operators cannot oppose dual technology’

New Delhi : The Department of Telecommunications (DoT) Tuesday in its affidavit to the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) said GSM players have no right to contest the government’s decision on dual technology.

“The petitioners have no right to oppose or challenge this policy decision. It’s a matter of policy and policy cannot be challenged,” Goolam E. Vahanvati, solicitor general of India, told IANS, quoting from the affidavit filed by DoT.

Leading GSM players, under the aegis of Cellular Operators Association of India (COAI), had approached TDSAT challenging the government’s decision to permit CDMA operators to rollout GSM services.

COAI has also written a letter to the DoT asking it to include COAI in the committee that is looking into the issue of subscriber-based spectrum allocation criteria.

TDSAT has postponed the hearing till Dec 12, till which time it has directed that no spectrum should be allocated to any operator.
