Muslims are a minority community in UP: Allahabad HC

New Delhi: The Allahabad High Court has set aside a two-year-old judgment of a single judge of the same court which had ruled that Muslims are not a minority community in Uttar Pradesh.

A Division Bench of the High Court ruled on Friday that the single judge had “erred in law and had travelled beyond pleadings and issues that had actually arisen between the parties.” The Bench comprising Justice S R Alam and Justice Sudhir Agrawal passed the order on a petition of the Uttar Pradesh Government, UP Minorities Commission and other organizations filed against the single judge order of April 5, 2007.

The single judge order was challenged by the state government the very next day and the Division Bench had stayed the order.

According to the Census 2001, Muslims are 18.5% of the state population of 166,197,921. According to the Census, 22.25% of the national Muslim population live in the largest state of the country.
