Non-bailable warrant renewed; Ma’dani to be produced in court by July 6

Bengaluru: The non-bailable arrest warrant issued against PDP chairman Abdunnasir Ma’dani accused in the Bengaluru blast case was yesterday renewed by the court. The first Additional Chief Metropolitan Magistrate ordered the police to produce Ma’dani before court on or before July 6.

The court order came on the request of the Central Crime Branch of the Bengaluru police as the time limit of the warrant issued on 15th of this month ended yesterday. The police have reportedly informed the court that the 31st accused Ma’dani and 32nd accused Shuhaib alias Faisal were absconding and that the police were not able to get hold of them. Meanwhile the court will consider the anticipatory bail petition submitted by Ma’dani on 29th.

The prime accused Thadiyantavide Naseer and 19th accused Shafas are now in Viyyur Central jail in Kerala as they are also accused in several cases including the controversial Kalamassery bus-burning case in the state. The Bengaluru court had issued body warrant against the two on June 15. They were presented before the court via video conferencing yesterday as the Viyyur Jail superintendent informed that they could not be produced in Bengaluru due to security reasons.

I have not given testimony against Ma’dani, says T Naseer

Thadiyantavide Naseer, the prime accused in the Bengaluru blast case and suspected to have links with PDP chairman Abdunnasir Ma’dani, yesterday said that he had not given any testimony against Ma’dani. He said this when he was brought out of the NIA court in Kochi. He was reportedly shouting, without any provocation, at the channel cameras that he had not given any testimony against Ma’dani, all that is spreading on the matter are wrong, the media should investigate and get to know who all are the accused and what was happening in the case. Naseer was brought to the court for extending his remand in the Kozhikode twin blasts case.

Naseer’s wife Femitha also reportedly said that Naseer had not said any word against Ma’dani. She was visiting him in the Viyyur Central Jail.

PDP leaders demanded that the case against Ma’dani be withdrawn as the prime suspect Naseer has revealed that he had not given any testimony against Ma’dani.

Meanwhile, a leading news channel in the state yesterday aired copy of the testimony of Thadiyantavide Naseer. It says that Ma’dani had asked Naseer to select a VIP area for the blast and that it should not be in crowded markets where there would be a lot of common people. Only a small group should be entrusted to carry out the blast as it would help not to leak out the matter. Also, there shouldn’t be a situation as in the Coimbatore blast case in which all persons included were jailed. Naseer has also reportedly told the police that Ma’dani was informed of the blast after the explosives and money were arranged.

However, Ma’dani’s lawyers have argued in the court, while considering the anticipatory bail petition, that the words of a person in police custody should not be taken as evidence. Naseer has been under judicial custody for months and so, there isn’t any sort of external influence on him.

The fasting satyagraha launched by PDP leaders at Anvarssseri entered its ninth day today. State vice-president Varkkala Raj, who had been fasting since the first day onwards, was yesterday arrested by police and taken to hospital as his health conditions were bad. Chandran V Thrippoonith, Kozhikode district secretary of the party, began to fast in his place. Famous human rights activist Gro Vasu took a one-day fast yesterday, expressing solidarity with the struggle.

Solidarity state president P Mujeeb Rahman, while inaugurating the satyagraha session, said that there was a deliberate attempt to grow terrorism by victimising Ma’dani through fake evidences and witnesses. He recalled that Ma’dani was jailed in Coimbatore for a decade by the same way. Ma’dani is carrying out social work after his release from jail, proving his innocence through legal battle. He said that the Kerala home ministry had the responsibility to explain the allegation that Ma’dani, who travelled always with the Kerala police, took part in the conspiracy. He added that the VS government should not repeat the mistake of former Nayanar government which handed Ma’dani ver to Tamil Nadu police.

Ma’dani was accused in the Bengaluru blasts of 2008 on April 12. The police reportedly said that evidence against Ma’dani was got from T Naseer. Ma’dani was named in the additional chargesheet submitted on June 11 and the Bengaluru court issued a non-bailable arrest warrant against him the next day. Ma’dani then submitted an anticipatory bail petition in the court. Ma’dani always maintained that he was innocent of the charges against him and has expressed his willingness to fight the legal battle to prove it.
