AIMPLB expresses concern over proposed matrimonial property law of Maharashtra

Mumbai: The proposed Matrimonial Property act (Rights of Women over marriage) by the Maharashtra government is one of the concerns of All India Muslim Personal Law Board (AIMPLB).

Besides Right to Education, Direct Tax Code and Waqf Bill, Adv. Abdul Rahim Qureishi, General Secretary and Spokesperson of AIMPLB expressed his concern over the draft Matrimonial Property bill 2012. The draft law prepared by the Maharashtra government seeks to give women rights of an equal partner in husband’s property.

Qureishi said, “Our government in center and state are blindly following laws of America and Europe. These kinds of laws will destroy family life in India. Because of these laws, couples in America and Europe are not marrying and the term like live-in relationship has developed.” He quoted a report which says that “53% of kids in USA don’t know who their father is?”

“India is a value based society where family plays an important role in the life of India. In the west modernity means immorality,” he further said.

Objections were also raised on the proposed property rights of Agricultural land in Uttar Pradesh through which only single women will get the right of property in the agricultural land. Qurieshi said, “Akhilesh Yadav, Chief Minister of Uttar Pradesh assured through a letter to the President of the Board that the proposed law will be amended.” We replied to Mr. Akhilesh Yadav to take action within three months.

The Board at its 22nd conference in Mumbai also discussed the issues of the mosques under Archeological Survey of India-ASI, who does not allow offering of Namaz. He said, “Board demands UPA government to ask ASI to allow offering of namaz in those mosques through a local management.”

Regarding Direct Tax Code Bill, Qureishi said, “It’s unfair to tax Trusts, Mosques, Temples and Churches.”

Minority Ministry of India ignored the recommendations of Sachar Committee and Joint Parliamentary Committee on Waqf.

We can’t accept any laws that interfere in Muslim Personal laws because our Personal laws are part of Islamic Shariat which is divine, he said.

Qureishi said the board will talk to the Chief Ministers of states who are sympathetic towards Muslims like Mamta Banerjee and Akhilesh Yadav.
