There is a divided opinion on Darul Qazas or Shariah courts amongst both Muslims and non-Muslims. Many women rights groups and secular Muslims groups feel that these shariah courts will not do justice to women and will interfere in the judicial process as they act as parallel courts. But are they are really parallel courts?
The constitution of India in Articles 25 and 26 give people the full freedom to practice and manage the affairs of their religion. This included arbitrator matters that are civil in nature. Darul Qazas do not deal with criminal matters.
With nearly 3 crore cases pending in the courts this could be a process wherein family disputes could be resolved provided the verdict is fair and does justice to the wronged person.
