New rules for armed forces’ property acquisition in Kashmir

Jammu : Addressing grievances of property owners in Jammu and Kashmir, the government Wednesday issued fresh guidelines simplifying the procedure for hiring or requisition of land and buildings by the armed forces.

The defence spokesman in Jammu, Lt. Col S.D. Goswami said, “The decision to issue the guidelines follows various representations from discontented owners whose properties were occupied by the armed forces and there was delay in regularisation of occupation of such properties due to various operational reasons.”

Henceforth, no land or building would be occupied by the armed forces without completion of hiring formalities. However, whenever their occupation becomes inevitable without first completion of the formalities, in the case of buildings, the Board of Officers would be convened promptly and proceedings completed within 60 days from the date of occupation of the building.

“In yet another decision, the defence ministry also delegated enhanced power substantially in favour of local commanders of the army and officials of defence estates for speedy disposal of rentals at the ground level,” said the spokesman.

There were many cases where the owners of land and buildings acquired by armed forces had not got their due rent or compensation for long time.
