Accused doctors granted conditional bail in Payal Tadvi suicide abetment case

The Bombay High Court has granted conditional to all the 3 accused doctors Hema Ahuja, Bhakti Meher and Ankita Khandelwal arrested for abetting Payal Tadvi to commit suicide by making casteist slurs and continuously harassing her.

Dr. Payal Tadvi, a postgraduate medical student attached to BYL Nair Hospital where she was subjected to humiliations every day by her 3 seniors for having secured the postgraduate seat on the basis of reservation.

Payal Tadvi, 26 years, belonged to a Muslim scheduled tribe and was a second-year post-graduate gynaecology student at TN Topiwala National Medical College was attached to the BYL Nair Hospital. Her seniors in their 3rd year of MD at the same college did not allow Tadvi in the labour room or to perform deliveries but assigned her to clerical work.

She mentioned in her suicide note to her parents about the harassment which forced her to take the extreme step and also the names of the 3 doctors who abetted her suicide.  Dr Payal Tadvi was found hanging in her hostel room on May 22.

The trio who were earlier absconding were arrested and have been in jail from the last 70 days as the special court rejected their bail in the month of June. Subsequently they moved the High Court wherein Justice Jadhav has granted them a conditional bail according to which they have to submit personal bonds of Rs.2 lakhs each and sureties of the same amount.

The three accused have to also appear at the Police station every alternate day. They have also been ordered to stay away from the BYL Nair hospital and also restrained from leaving the city.

Their license to practise medicine has been suspended till the period of the trial.

They are being tried under the various provisions of the SC and ST ( Prevention of Atrocities Act) apart from IPC.
