Chief Justice of India praises Islamic penal code as deterrent against crime

Hyderabad: The Chief Justice of India K G Balakrishnan has hailed the Islamic penal code saying they were effective in deterrence against the criminal offenders. Addressing a workshop on "Growing Crimes – deterrent punishment : search for appropriate theory of punishment", organized by the organization of Retired Judges and NALSAR University at the Andhra Pradesh High Court Balakrishnan gave the example of Gulf countries. "People say the laws in those countries were harsh but it is a fact that because of the harsh punishments, the crime rate in those countries is very low". Women can move around even at midnight with out any fear, he said. Even traffic rules were so strict that there were very few traffic accidents in those countries.

He recalled that till 1857, Islamic penal system was in force in India and the law and order situation in the country was very good. "The introduction of Indian Penal Code was a good move but the law and order situation in the country did not remain the same", Chief Justice said.

Pointing out that in contrast to the Gulf countries, India was a democratic country. "But in our country neither the women can move around with out fear nor there is any respect for the traffic rules", he said.

Pointing out that there were 8000 judges in the country to deal with the criminal offences, the Chief Justice expressed his concern over the huge disparity in sentences awarded by different judges for the similar crimes. The disparity is so huge that they range from six months to life imprisonment for the crimes of the similar nature, he said.

He was also unhappy that the system of granting bails was not working properly and some bail petitions were pending in the courts for fifteen years. "As a results jail in the country were full of under trial prisoners".

Justice AR Lakshmanan, chairman, Law Commission of India said that 56 lakh criminal cases were pending in the courts in the country.

One of my friends is saying that this information is not authentic and it is just a propaganda of muslims. He also says why this news is not covered in any media? How come BJP did not make hue and cry if this is true? Can any one post some proof of autheticity of this news. Thanks

yes IPC is detternat but answer doesnot lies in Islamic laws but in stringent laws , all those looking for islamic laws can go to pakistan. two circles is pro muslim and anti india .I wonder what would happen if CJ tomorrow says islam is spreading terrorism in india(which btw is true) then two circle wont report or there will be a flame war in the comments.
Such comments shows that indian muslims are muslim first then indian which is the major cause of problem.jai hind.

IPC as deterrent

The Honourable chief Justice K.G. Balakrishnan praises the Islamic Penal Code as an effective deterrent against rising crimes in India. In support of his praises he brushes aside the severity of the law and cites Gulf countries implementing the Islamic Penal Code (IPC) as a system which ensures safety to humanbeings. The result is less crimes and harmonious living. But has honourable chief justice ever proposed to the government through law commission to adopt Islamic Penal Code or incorporate some of laws from Islamic Penal Code into the Indian Penal Code?
The Islamic Penal Code assures justice, liberty, equality and promotesdignity and fraternity among people. And this is exactly what the Preamble to the Indian Constitution assures to Indians who are citizens of sovereign social secular democratic republic.

First we should Appreciate our Chief Justice of India for Accepting the the truth that for todays criminal acctivities around the world especially in democratic countries like india the only solution to control the crime is to follow islamic law, not only the CJI even other judges having the same feeling but few like Mr. K.G. Balakrishnan coming out with open statement, And Also there is no exact punishment for particular crime in Indian penal Code As CJI said Justice given to the criminals according to their influence and social status and depending on judges mood, As Mahatma told when a women goes out in midnight without any fear that day is possible in india if only islamic law is implemented as it was in 1857. Even BJP's leader Advani Told the same thing when he was holding ministry office.

Good to hear that from a CJ. Any unbiased person is bound to reach that conclusion.
How come CJI's remarks were not reported in the national press? Or did we miss it? Even in the Twocircles' reporting there is no mention of the date of the event. Is it how you report news?

Other side of the coin

Sir,
Mere harsh and stringent rules to combat crime is not the only approach of Islamic law. On the other hand it closes all the evil doors that routed towards the crime and opens the avenues and opportunities to meet the basic needs of the people. In addition to this the Islamic Ideology plays a very important role to combat crime. The ideology of answerablity of our life before our Creator, the strong belief in the day of judgement. A model society formed based on these principles by the Prophet Muhammed (peace be upon him) could be the best example to understand this subject in right perspective.
