‘We’ not ‘They’ are looting waqf properties

Mumbai: In June 1798, Nawab Ayaz Ali Khan might not have donated a garden of 1549 Sq.Mt. for a burial ground if he knew that it will not be used for the purpose and later trustees will sell a part of it because they are unable to bear the maintenance charges.

There are many waqf properties in Maharashtra, and in the entire country, which have been sold by Muslim trustees themselves for personal gains. Take some cases from Maharashtra in brief:

Nearly 1100 Sq.Mt. waqf land, registered under Bombay Public Trust Act as B-96 and in Maharashtra Wakf Act, 1995, MSBW/MUM/-87/-08 was sold to a builder for redevelopment for Rs.11 lacs and 2 flats of 560 Sq.Ft.

The story in Kausa, Mumbra of Thane district is very interesting. About 52 acres of wakf land was leased to a Non-Muslim farmer and he used to farm there for the last 50 years. He used to donate one third of his earning to the mosque but when he fell ill and thought he will die he returned the land to the trust.

Locals alleged that Trustees have sold the property worth Rs 280 crore for a meager amount through which they are earning only Rs.18000 per month.

Whereas Chief Trustee Abdul Gani denied that the trust had so much property. He said, “We have leased this property to one Azaad Ghare, and he had sub leased it to others for which we have no information.”

Locals complained it to the Wakf Board, met with the Wakf Minister, Mr. Arif Nasim Khan and then with the Chief Minister of Maharashtra Mr. Ashok Chavan with all the proof but in vain.

The Wakf Board CEO, Mr. S.S. Ali Qadri first issued NOC and after the complaint then reissued notice to stop the work on the wakf land but locals alleged that the signature on both the documents is different.

Besides, the 221 Sq. Yard land having C.S.NO. 791 of Moosa Haji Hasham Charitable Trust PTR No. B-352 (Mumbai) is situated at Khetwadi, Girgaum. It has Ground plus one floor structure having 8 shops and 9 rooms which are all rented. This was sold for Rs. 83 lacs to Shri Jethmal Jain.

Sayaadi Abdul Kadir Hakimuddin Saheb Fateha Trust PTR No. B-1092 (M) sold its property bearing C.S.NO. 1252 which is of 126 Sq.Yard. The Trust sold it for Rs.15 lacs to Sterling Enterprises. The property is recorded in Schedule 1. It is a Ground plus 3 story building and in a dilapidated condition.
According to the Wakf Act 1995 all the B’ Series wakf properties automatically comes under the Wakf whether registered with the wakf board or not.

Asia’s largest tower is coming up on the wakf land at Churni Road, South Mumbai. Sources have also told that Haji Zakariya Haji Ahmed Patel Trust has sold its wakf property in Malad, a western suburb of Mumbai. A wakf property in Sewri, an eastern suburb, has also been sold.

HAND OVER WAKF PROPERTIES TO R.S.S.

And ask RSS to do something.. make use of these properties. In any case, they are going to RSS workers... so why not institutionalize this theft ?

Congress has done very dirty work., vis-a-vis Indian Muslims post 1947. Its secularism was a fraud. Maulana Azad was the last Congress President 1946, and Nehru sabotaged his Cabinet Mission Plan., because he wanted to be PM at any cost.

I am willing to shake hands with BJP... but BJP has not YET realised the importance of Indian Muslims. If it talks about RAJ DHARMA and SENSE OF JUSTICE (SAMAJIK NYAY)., it can bury the Congress (I) for ever.

But hatred for Muslims and Islam is the obstacle., the knot in BJP's heart., and Congress(I) is taking advantage of THAT flaw in BJP.

Congress (I) has become a family pvt. ltd. company now. It must be laid to rest.

WAQF

THERE IS NO LEADER AVAILABLE IN OUR COMMUNITY TO PROTECT WAQF ESTATE.WAQF ESTATE IS OUR COMMUNITY PROPERTY. IT IS DUTY TO EVERY COMMUNITY MEMBER TO PROTECT WAQF PROPERTY FORM ANTI WAQF PERSON.IN BIHAR OUR WAQF IS BEING ENCROACHED BY THE GOVERNMENT ALSO.

It's NOT "they" or "us" - Question is.....

Your news-report highlights the list of WAQF properties being mis-used, looted, sold, encroached, or whatever....

And it IS NOT "they" or "us" as titled !!! The question is: LEGAL or ILLEGAL.

Once the authorities are drawn to LEGALITY or ILLEGALITY angle, not just Waqf Board, but also those involved in ILLEGAL ACQUISITION of THOSE PROPERTIES will have to face LAW. And "government(s) concerned" cannot escape from answering and imparting JUSTICE or RULE of LAND / LAW.

If a thief OR bandit enters your house to loot, and you willingly give-in OR allow him/her to commit crime. In such a situation both: "criminal" and so-called "victim" are guilty of crime - and hence punishable.

In my view, cases of Waqf Properties needs to be treated accordingly.

Wakf Properties Cant Be Sold.

According to Law., Wakf Properties Cant be SOLD by the Mutawalli (Keeper / Manager). Knowing this (1)how do CHOR-MUTAWALLIS do it ? and (2) how does the Registrar Register the Document in favour of the purchaser.... or is simple Possession given to the corrupt politician.. who then sits.. and secures his title thru KABZAA (Physical Possession is 9 points in Law out of 10).

This cannot be done without co-operation between the corrupt Mutawalli + Registrar Office + Revenue Department + Local Politician. All criminals agree... to rob the Muslim community.

This is the Saraansh. Viceroy Hotel (Owner : BJP MP) in Hyderabad stands on a Wakf Graveyard. Post 1947., RSS leaders' primary job was to illegally occupy Muslim Graveyards.. hire Pahelwans to remove graves and establish AKHARAS... and subsequently... the Pahelwans were removed...to build a Hotel ! This game is going on since 1947-to-date. Illegally occpying Muslim property is the ESSENCE of Hindutva.

Everybody is looking out for easy money. Especially if it is coming out of the public cause. Nobody can take over the property of waqt board unless the trustee collude with the buyers. Rightly mentioned all these are happening at the collusion of the trustee with the vested interested.
