NHRC issues notice to Delhi Police in alleged illegal detention of Irfan Landge

New Delhi: National Human Rights Commission (NHRC) has issued an order to the Commissioner of the Delhi Police in the alleged illegal detention of Irfan Langde by the Special Cell.

Irfan was allegedly picked from Thane, a suburb of Mumbai, on October 5, 2012 from his brother-in-law’s house, by a team of Special Cell. However, police showed his arrest on October 10 from Jaipur.

Mustafa Landge, Irfan’s father had alleged in the media that the police had threatened him to ‘co-operate’ else they would ‘deport’ his son to Nepal or Pakistan. He had specifically named Special Cell officials who met him in a hotel in Mumbai. He also learnt that his one son-in-law Asad Khan was also in detention.

Irfan (30) along with three others arrested earlier have been shown by the Delhi Police to be members of Indian Mujahedeen and have been linked with the Pune blast case.

Based on media reports Delhi based civil rights group Association for Protection of Civil Rights (APCR) had filed a complaint to the NHRC demanding intervention, fair probe, and an independent criminal investigation against the culprit police personnels.

Speaking to TCN, APCR coordinator Syed Akhlak Ahmad pointed out, “This is clear violation of the Supreme Court guidelines in the matter and misuse of powers designated to the Police.” He added, “This is also an unlawful activity as well as a criminal act performed by the officers of a law enforcement agency and the culprits must be duly punished.”

In its notice the Law Division of the NHRC has demanded a report in the matter within four weeks of date of receipt of the notice. The Commission has added that it may take necessary actions as it ‘deems proper’ in case of default.
