Islamabad : President Pervez Musharraf Saturday lifted the state of emergency, revoked the Provisional Constitution Order and restored the Constitution.
The Order came 42 days after the emergency was imposed on November 3 to counter “ascendancy in activities of extremists” and “increasing interference by some members of judiciary”.
The Order titled ‘Revocation of Proclamation of Emergency Order 2007’ is in pursuance of President Musharraf’s pledge to the nation to lift the emergency before December 16.
The Presidential Order issued by the Cabinet Division revoked with immediate effect the previous order on the Proclamation of Emergency, issued on November 3 and repealed the Provisional Constitution Order No.l of 2O07.
The Order revived the Constitution as amended by the Constitution (Amendment) Order 2007 (P.O.No 5 of 2007) and the Constitution (Second Amendment) Order, 2007.
The Presidential Order allowed Chief Justice of Pakistan and judges of Supreme Court, judges of Federal Shariat Court and the High Court judges to take oath under Constitution who were already holding offices at the time of revival of Constitution.
The Order said it would not nullify the previous orders passed under the emergency.
The Order will also not affect any right, privilege, obligation or liability acquired, accrued or incurred under emergency, the PCO and the Oath of Office (Judges).
According to the Order, the general elections will be held as per previously announced schedule.
In case of any difficulty arising in the implementation of the Order, the President may make provisions and pass orders accordingly for adjustment. The validity of such provisions could not be challenged in any court including Supreme Court, Federal Shariat Court, High Court and at any forum of authority.
