MCD moves apex court against regularisation deadline

New Delhi : The Municipal Corporation of Delhi (MCD) Thursday moved the Supreme Court against the May 31 deadline imposed by the Delhi High Court for an MCD scheme for regularisation of unauthorised constructions in the capital.

A Bench of Justices Arijit Pasayat and B.P. Singh posted the matter for hearing June 18 after the MCD counsel Sanjiv Sen apprised the bench of the MCD's Special Leave Petition seeking the relief for Delhi residents.

The MCD scheme, notified last December, sought to regularise such unauthorised constructions in Delhi, which despite being illegal according to the prevailing building by-laws, were given legal sanctity in the 2021 Master Plan of Delhi (MPD).

The Dec 22, 2006 scheme of MCD formulated a "self-assessment policy" for Delhi residents to enable them regularise their unauthorised constructions on payment of fees to the municipal body. The scheme did not fix any time limit for residents to avail of the opportunity.

The scheme was aimed at relaxing the ground coverage and the floor area ratio (FAR) for residential constructions.

The Delhi High Court, however, fixed May 31, 2007 as the deadline for residents to avail benefits of the scheme. The high court also ordered that the applicants to the scheme will also give an undertaking that they will demolish all unauthorised constructions which are non-compoundable.

The apex court earlier on an application from the MCD had modified the high court directions and ordered MCD to accept the residents' applications without the undertaking stipulated by the high court.
