SC permits private colleges in Kerala to conduct CET

New Delhi : The Supreme Court Monday allowed a consortium of private medical and engineering colleges in Kerala to conduct a separate common entrance test (CET) for ensuing academic year.

Justice B.N. Aggarwal, granted the permission, while admitting a petition by the Kerala government against the state's high court order, which struck down some provisions of the Kerala Professional Colleges (Prohibition of Capitation Fees) Act 2006 as "unconstitutional".

The bench, however, refused to accede the state government's counsel K.K. Venugopal's plea to stay the high court's order quashing part of the law and to restrain the private colleges from conducting the CET.

The state government had moved the apex court, challenging the Jan 1, 2007 order of the high court, which quashed several provisions of the state law, officially known as Kerala Professional Colleges (Prohibition of capitation fee, Regulation of admission, Fixation of non-exploitative fee and others measures to ensure equity and excellence in professional education) Act 2006 as being "unconstitutional."
