The District & Sessions judge at Ghaziabad Monday adjourned the hearing of Krishna’s bail plea till Sep 19.

Fatah Chand Sharma, Krishna’s lawyer, in his bail application submitted that he should be released since there was no evidence against him.

He also pointed out that Krishna had been in “illegal” custody of the Central Bureau of Investigation (CBI) between May 16 and June 13, the day the agency formally declared him detained.

Moreover, Vijay Mandal, another accused, was last week granted bail on similar grounds, he argued.

The agency has not recovered the weapon of murder and other articles related to the crime in spite of detaining the accused for more than three months and it has not produced any witness, stated the lawyer in the bail application.

Meanwhile, Raj Kumar’s bail application would be heard Tuesday in the court of Special Magistrate Sapna Mishra, his lawyer Naresh Yadav said.

Aarushi, 14, was found murdered at her Noida home May 16 and her family’s domestic help Hemraj was found dead the next day.

Krishna worked as compounder to Aarushi’s dentist father Rajesh Talwar, while Vijay Mandal and Raj Kumar were domestic helps, respectively, to a neighbour of Talwar and to friends of Talwar, the Durranis.
