New Delhi: The Supreme Court Tuesday asked the Uttar Pradesh government for its stand on a lawsuit by a judicial officer challenging his ouster from the state’s rights panel.
A bench of Chief Justice K.G.Balakrishnan, Justice P.Sathasivam and Justice B.S.Chauhan issued the notice on the plea of J.S.Yadav, who was removed from the panel after Mayawati came to power in May 2007.
Yadav, who is from the state’s subordinate judiciary, said he was appointed member of the Uttar Pradesh Human Rights Commission in 2006, during the regime of Mulayam Singh Yadav.
At the time of his appointment, Yadav said he had an experience of over four years as a judicial officer, while the state rights panel had no rules stipulating a certain period of experience for a member’s appointment.
But soon after the Mayawati government came to power, a new notification was issued, stipulating at least seven years of experience for appointment as member of the rights panel.
Yadav said he was subsequently removed from the panel, adding that even the Allahabad High Court dismissed his plea against his ouster.
