Bengaluru: The Karnataka High Court yesterday rejected the anticipatory bail plea submitted by Abdunnasir Ma’dani, the 31st accused in the 2008 Bengaluru blast case. Criminal Single Bench Judge Js N Ananda denied bail for Ma’dani on grounds that bail could not be allowed considering public interest, home security and national security as he was accused in a terrorism case. Ma’dani has decided to approach the Supreme Court for anticipatory bail.
The Karnataka High Court reportedly stated that there was prima facie evidence against Ma’dani in the accusations of terrorist activity, providing protection to the accused etc. It made it clear that the anticipatory bail plea could not be possible as per the Illegal Activities Prevention Act Section 43 D 4. The court also directed that special consideration should be provided to Ma’dani if he is arrested as he is handicapped and ill.
Meanwhile, the non-bailable arrest warrant issued against Ma’dani has been extended for two more weeks by the Bengaluru Additional Metropolitan court. The warrant was extended till August 17 at the request of the police as yesterday was the last date of the warrant.
Ma’dani said that he would not object if the Karnataka police came to arrest him. Situations are leading to offer the Ramzan fast in solitude. The history of solitary fasting in nine Ramzan months in Coimbatore and Salem jails is going to repeat. I was not very confident of getting the anticipatory bail. I was accused as it was realized that Thadiyanatvide Naseer was not enough to balance with the new circumstances in which the role of Hindutva terrorists in several bomb blasts are getting revealed and BJP leader and Gujarat Home Minister Amit Shah was arrested in the name of terrorism. I am speaking against and opposing terrorism not fearing the police, but because I believe in the Holy Qur’an, he added.
However, PDP working chairman Poonthura Siraj said that nothing can be said on what the party members and others would do if the Karnataka police came to arrest Ma’dani. It can be seen then. The HC decision was unfavourable. He added that they would approach the Supreme Court for justice.
Meanwhile, the Kerala Home Minister Kodiyeri Balakrishnan reportedly said that neither the Karnataka government nor the Karnataka police had contacted the state seeking help regarding the arrest of Ma’dani. However, the state would provide help if the government or police asked.
The Karnataka police submitted the additional chargesheet in the Bengaluru blast case naming six including Ma’dani as accused on June 11, 2010. The chargesheet was submitted after the arrest of prime accused Thadiyantavide Naseer and Shafas. The anticipatory bail plea submitted by Ma’dani in the Bengaluru fast track session’s court was rejected on July 9. This prompted Ma’dani to approach the High Court on July 16.
