    (a) & (b): The major new initiatives taken by the Ministry in recent past for propagation and adoption of various renewable energy sources in the country are as under: A National Solar Mission has been approved with first phase target of 1100 MW grid-interactive and 200 MW off-grid solar power by 2013. Following new schemes have been introduced: o Generation Based Incentive for wind power projects with a capacity addition target of 4000 MW during 11th Plan period. o Schemes for SPV Power plants at tail-end of grid and Roof-top SPV systems for diesel abatement, with a target of 8.25 MWp for 11th Plan. o UNDP/GEF assisted project for large-scale promotion of Solar Water Heating systems initiative. o Scheme for promotion of Green Buildings with target of 35 lakhs sq.m. covered area. A National rating system ‘GRIHA’ has been introduced. o Scheme for Incentivising Banks for financing Solar Home lighting Scheme with target of 2.5 lakh systems till March 2011. o Scheme for demonstration of Renewable energy systems at Iconic buildings o Scheme for micro-hydel /water-mills for border areas with target of installation of 50 micro-hydel and 2000 watermills during 11th Plan. Focus on promotion of power generation from rice husk for rural electrification. Policy and Regulatory initiatives relating to renewable power: Normative guidelines for tariff setting for renewable power issued through CERC; scheme for Renewable Energy Certificates , etc

    (a) to (d) The Prime Minister’s New 15 Point Programme for the Welfare of Minorities was launched in June, 2006 incorporating programme specific interventions. The new programme envisages location of a certain proportion of development projects in minority concentration areas. It also provides that, wherever possible, 15% of targets and outlays under various schemes should be earmarked for minorities. Targets fixed for schemes included in the programme considered amenable to earmarking and the achievements made during 2008-09 are available in the website of the Ministry on www.minorityaffairs.gov.in. The programme provides for a close monitoring mechanism and the status of implementation has been reviewed regularly.

    (a) to (d) : Prior to Gauge conversion of Mathura-Kasganj section, 7 pairs of train services (3 pairs of Mail/Express services and 4 pairs of passenger trains)were operating on the Meter Gauge section. At present i.e. after gauge conversion, 5 pairs of special train services (2 pairs of mail/express services and 3 pairs of passenger trains) are operating on the said Broad gauge section. To cater to the needs of the section, one pair of passenger train has been announced in the Railway Budget, 2009-10, which is in addition to the one pair of Express train service viz. 5107/5108 Mathura-Chhapra Express announced in Railway Budget, 2008-2009.

    (a) and (b): The Government is promoting usage of Information Technology in the States for better Governance and delivery of services to the citizens electronically. National e-Governance Plan envisages better, efficient, transparent and electronic delivery of G2G, G2C and G2B services. The details of major e-governance projects in the States of Uttar Pradesh and Bihar are given in the Annexure. Moreover, Software Technology Parks of India (STPI) has created 51 Software Technology Parks for promoting IT across the country. 4 STPI Centres have also been established in Uttar Pradesh and one Centre in Bihar.

    COMMON SERVICE CENTRE (CSCs) – PROJECT
    In the State of Uttar Pradesh and Bihar 17,909 and 8463 no of CSCs respectively are to be set up. Till November end about 5000 CSCs in UP and about 5500 CSCs in Bihar have been set up.
    e-DISTRICT PROJECT
    Uttar Pradesh
    e-District pilot project in six districts of Uttar Pradesh (Rae Bareli, Sitapur, Gorakhpur, Sultanpur, Gautam Budha Nagar & Ghaziabad) has been approved at the total outlay of Rs. 1891.84 lakhs. CeG is the State Designated Agency (SDA) for implementation of the project.
    e-District pilot project in 4 districts of Bihar has been approved of the total cost of Rs11.48 crore for Nalanda, Madhubani, Aurangabad and at an outlay of Rs.274.32 lakhs for Gaya district..
    Bihar State Electronics Development Corporation Limited (BSEDC Ltd) is the State Designated Agency (SDA) for implementation of the project.

    (ii) BSNL plans to cover villages having population more than 1000 by mobile services progressively in next three years.

    (iii) Remote and far-flung areas, which are not possible to be covered with terrestrial technology, are planned to be covered with Digital Satellite Phone Terminals (DSPTs).

    (a)&(b) Almost all zones of Municipal Corporation of Delhi, New Delhi Municipal Council (NDMC) and Delhi Cantt area are prone to mosquitoes, depending upon the season. The state of mosquitoes, as indicated by the larval density of types of mosquitoes in Delhi, zone-wise, during the year 2009 (upto October) is given in Annexure.

    (c) The following actions are being taken by the Government to check the menace of mosquitoes:
    Ø Engagement of 3500 domestic breeding checkers through Municipal Corporation of Delhi for checking of houses for breeding of mosquitoes, particularly Aedes mosquitoes which spread Dengue fever.
    Ø Invocation of Section 269 of Indian Penal Code for control of mosquito breeding. In various rounds for checking of domestic breeding, 51,282 houses were found positive for breeding during the current season. Legal notices were issued to 49,090 houses and prosecution was launched against 9,887 houses.
    Ø Meetings with various stakeholders such as Northern Railways, CPWD, Irrigation & Flood Control Department, Delhi Jal Board and Delhi Cantonment Board for sensitizing them about prevention & control of mosquito breeding.
    Ø Creation of awareness through newspapers, mass media and local folk media.
    Ø Focal insecticide spray with Pyrethrum Extract 2% in areas from where Dengue or Malaria cases have been reported.
    Ø Anti-larval/insecticidal spray in known water collections for control of mosquito breeding.
    Ø Trainings for capacity building of field staff in all Zones of Delhi.
    Ø Use of temephos granules in water coolers for prevention of breeding of mosquitoes.

One pilot who was detected positive during Pre-Flight Medical Check and Breathalyzer test in the recent past, was grounded immediately and was punished as per the company policy, which is in accordance with the Civil Aviation Requirement(CAR) of Directorate General of Civil Aviation (DGCA).

    (c): As per the requirements of the CAR on the subject, issued by DGCA, appointed doctors conduct Pre-Flight Medical Check and Breathalyzer Test on Pilots and Cabin Crew, while actions to be taken on erring pilots and cabin crew are decided as per provisions of CAR Section 5, issued by DGCA.

Appropriate disciplinary action has been taken against the concerned staff. In case the theft of a passenger baggage is established, compensation is paid on the following basis:

    i) Domestic sectors – Rs.450 per kg. ii) International sectors – USD20 per kg.

    (c): In order to prevent such incidents of theft/pilferage, Security personnel are deployed to maintain surveillance at check-in counters, baggage make-up area and aircraft holds. The ground staff loading/off-loading of passengers baggage are frisked while entering/exiting aircraft holds. Baggage containers are sealed with the security seals and escorted from the baggage make-up area to the aircraft and its loading on the aircraft is monitored. The arrival baggage/containers are escorted up to the baggage break-up area and activities there are closely monitored.

    (a) & (b) : 18 requests/demands have been received by North Eastern Railway for providing computerized reservation facility. Out of this, 4 stations have already been provided with computerized reservation facility and work is in progress at 7 more stations. List is appended.

    (c) : As per existing policy, computerized reservation facilities are generally provided at locations where the assessed potential is about 100 transactions per day. At places where assessed potential is less than 100 transactions per day, this facility is provided along with the Unreserved Ticketing System. Computer Reservation System is also provided at selected post offices.

    (d) : Proposal at balance stations will be taken up as soon as the requirement reaches the normative level.

    (a) & (b): No, Sir. During the year 2009-10 (upto October,09), 9.61 lakh checks have been conducted against ticketless/irregular travel, as against 9.11 lakh checks during the corresponding period of last year.

    (c): Regular/surprise checks are conducted in association with Railway Magistrates and Police against ticketless/irregular travel. These checks are monitored by officers at various levels and intensified during peak rush and festival periods. Besides, Intensive Check Posts have been set up at important stations to curb ticketless travel in unreserved segments. In addition, campaigns are also launched through various media to educate the public about the consequences of travelling without tickets. To deter ticketless/irregular travel, the minimum penalty has also been enhanced from Rs.50/- to Rs. 250/- with effect from 01.07.2004.

    (a) to (d) Special trains are run on various sectors for clearance of extra passenger traffic during peak seasons and festival period including Idul’l Fitr and Idu’l Zuha keeping in view the pattern of traffic, operational feasibility and availability of resources. The basis of running special train is mainly past experience and anticipated rush which may be due to different reasons including the occasion of festivals. Separate data for special trains run for a specific festival is not maintained. Special trains are also run by Railways on Full Tariff Rates as per specific request made by a party. Requests for special trains are received at various levels i.e Station, Division, Zonal and Railway Board and necessary action as found operationally feasible and commercially justified is taken. No compendium of statistics for such requests is maintained.

    (a): A cumulative grid-interactive power generation installed capacity of around 15,539 MW from various renewable energy sources mainly wind, small hydro, biomass and solar energy has been set up as on 31.10.2009, which corresponds to over 9 per cent of the total power generation installed capacity from all sources in the country. In addition, a large number of decentralized renewable energy systems/ devices, such as, biogas plants, solar photovoltaic systems, solar cookers, solar water heating systems, aero-generators, biomass gasifiers, etc. have also been deployed in the country and supplementing conventional energy. Even though the contribution of renewable energy systems to energy–mix is low, their decentralized and distributed nature offers many socio-economic benefits.

    (b): A potential of around 90,000 MWeq for energy/power generation from different renewable energy sources (excluding solar) in the country has been estimated which includes 48,561 MW from wind, 14,294 MW from small hydro and 26,367 MW from bio-power. The potential for solar energy is estimated for most parts of the country at around 20 MW per square kilometer of open, shadow free area covered with solar collectors.

    (c): Significant achievements in grid-interactive renewable power generation capacity have come mainly from wind power (10,891 MW), small hydro power (2,520 MW) and biomass power/ cogeneration (2,057 MW).

    (d) : A capacity addition of 12,300 MW grid-interactive renewable power is targeted during the 11th Plan. Further capacity addition of around 57,500 MW is envisaged during the 12th and 13th Plans, leading to a total capacity of around 80,000 MW by the end of the 13th plan period (comprising 43,500 wind power, 8,900 MW small hydro power, 7,400 MW bio power and 20,000 MW solar power as envisaged by 2020 under the National Solar Mission approved recently), which would correspond to a share of about 9% in the then likely electricity-mix from all sources.

    (ii) Those PTOs who are applying since last three Haj seasons but no quota was allocated to them last year, have been allocated a quota of minimum 50 seats provided they were otherwise eligible.

    (iii) Those PTOs who are applying since last two Haj seasons but no quota was allocated to them last year have also been allocated a quota of minimum 50 seats provided they were otherwise eligible

    (iv) The PTOs who had applied since last one year only i.e. in Haj-2008 and those fresh applicants who have applied this year could not be considered for allocation of quota for Haj-2009.

    (b) Efforts are being made to make the distribution and release of private tour operators quota in a more rational and transparent manner by applying the policy decided by the government uniformly among the old and new Private Tour Operators (PTOs) in order to ensure that there is a healthy competition among the old and new PTOs and the haj pilgrims travelling through PTOs have the choice for comfortable and economical services for their pilgrimage.     STATEMENT IN REPLY TO PARTS (a) TO (c) OF RAJYA SABHA STARRED QUESTION NO.83 FOR 25.11.2009 REGARDING “STRENGTHENING THE MECHANISM FOR PROTECTION OF HUMAN RIGHTS”

    (a) to (c): The principles of human rights are an integral part of the Constitution of India which guarantees basic human rights and fundamental freedoms to all citizens, irrespective of religion, race, caste, sex, place of birth or any of them. The Government of India has enacted the Protection of Human Rights, 1993 which lays down the mechanism for protection of Human Rights. The National Human Rights Commission (NHRC) has been set up under Section 3(1) of the said Act for protection of Human Rights. Further, as per Section 21 of PHR Act, 1993, the State Governments may set up State Human Rights Commissions. The NHRC has been vested with following powers and functions in order to discharge its mandate of protection of Human Rights.

    NHRC enquires into complaints under the said Act. The Commission has got full powers of a Civil Court trying a suit under the Code of Civil Procedure 1908.

    The enquiry proceedings before the Commission are deemed to be judicial procedure. The Commission may transfer any complaint filed or pending before it to the State Commission of the State from which the complaint arises and the State Commission shall dispose of the complaint as if it were a complaint initially filed before it.

    Similarly, for the purpose of investigation, the Commission may summon and enforce the attendance of any person and examine him, require the production of any document and requisition any public record from any office.

    NHRC can perform any or all of the following functions:
    i) To enquire into any complaint of violation of Human Rights.
    ii) To intervene in any proceeding including any allegation of violation of Human Rights pending before a Court.
    iii) To visit jails and other such institutions and make suitable recommendations to the Government.
    iv) To review the safeguards provided by the Constitution / any law for protection of Human Rights.
    v) To study international conventions/covenants and make suitable recommendations.
    vi) To undertake and promote research / literacy / awareness in the field of Human Rights.
    vii) To encourage the efforts of Non-Governmental Organisations and institutions working in the field of Human Rights.

    The State Human Rights Commissions have been vested with similar power / functions as NHRC within the justification of their respective States.

    The Government of India and the NHRC have been actively pursuing with the State Governments for setting up of SHRCs and Human Rights Courts.

    Due to persistent efforts of Government of India and NHRC, 18 States have set up the State Human Rights Commissions and 10 States have set up Human Rights Courts at district level for protection of human rights.

    In view of the facts pointed above, the existing mechanism for the protection of human rights is adequate and it can be strengthened further by State Governments by implementing the provisions of the PHR Act, 1993 effectively and efficiently, as “Police” and “Public Order” are State subjects under the Constitution of India.

    (a):- On 19.10.2009, C – 525 aircraft VT – PSB of M/s Orbit Aviation took off after sunset from Dumka Airstrip, which is an uncontrolled airfield, in the twilight period. Investigation revealed that there was darkness and therefore lights of the vehicles present by the side of Airstrip were switched on, though they were not used for the purpose of lighting the runway for departure of the aircraft.

    (b) and (c):- Investigation revealed that the aircraft took off after sunset, in violation of safety guidelines and Visual Flight Rules. Based on investigation both the pilots were grounded for 15 days and were given a warning.

    (d):- Guidelines already exist on the subject and operators have been advised to strictly follow them.

    (a) to (e). The Prime Minister’s New 15 Point Programme for the Welfare of Minorities was launched in June, 2006 incorporating programme specific interventions. The new programme envisages location of a certain proportion of development projects in minority concentration areas. It also provides that, wherever possible, 15% of targets and outlays under various schemes should be earmarked for minorities. The programme provides for a close monitoring mechanism at the Centre, State and District levels. The status of implementation of the new programme has been reviewed six times. The Ministries/Departments whose schemes are included in the programme have reported achievements and the same for the year 2008-09 is annexed. Three new schemes have been included in the new 15 Point Programme viz National Rural Drinking Water Programme (NRDWP) of the Department of Drinking Water Supply, and Urban Infrastructure and Governance (UIG) and Urban Infrastructure Development Scheme for Small and Medium Towns (UIDSSMT) of the Ministry of Urban Development. The Government has also approved inclusion of certain numbers Members of Parliament and Members of the Legislative Assembly in the State and District Level Committees for implementation of the Prime Minister’s New 15 Point Programme for the Welfare of Minorities.

    (a) & (b): Yes, Sir. The details of minority concentration districts (MCDs) and the scheme of Multi-sectoral Development Programme (MsDP) for minority concentration districts are available on the website www.minorityaffairs.gov.in.

    (c) & (d): The Multi-sectoral Development Programme (MsDP) for minority concentration districts is a special area development programme and has been launched in the 2008-09 for addressing the development deficits in socio-economic parameters and basic amenities identified by a baseline survey. Identified development deficits would be made up through a district specific plan for provision of better infrastructure for school and secondary education, sanitation, pucca housing, drinking water supply, basic health infrastructure, ICDS centre etc. The programme aims at improving the availability of such infrastructure and benefits provided through different Centrally Sponsored Scheme (CSS) by augmenting them. Such infrastructure and benefits are meant for all communities and the programme does not permit any change in the existing CSS guidelines. To ensure that the maximum benefits are given to the minorities in the MCDs, the programme envisages that priority be given for location of infrastructure and benefits in villages/blocks/localities having a substantial minority population.

    (a) to (e): In accordance with Section 2(o) of the Jamia Millia Islamia Act, 1988, the “University” means the educational institution known as “Jamia Millia Islamia” founded in 1920 during the Khilafat and Non-Co-operation Movement in response to Gandhiji’s call for a boycott of all Government-sponsored educational institutions which was subsequently registered in 1939 as Jamia Millia Islamia Society, and declared in 1962 as an institution deemed to be a University under section 3 of the University Grants Commission Act, 1956, and which is incorporated as a University under the said Act.
    The question relating to minority institution status of Aligarh Muslim University is pending before the Hon’ble Supreme Court of India, where the interpretation of the term “establishing” a University, as was laid down in the “Azeez Basha” matter, is under challenge and that the orders of the Hon’ble Supreme Court in that matter will have a bearing on the issue relating to the minority character of Jamia Millia Islamia, which is pending before the Hon’ble National Commission for Minority Educational Institutions.

    (a) to (e): The proposal in regard to establishing a Central Madarsa Board, through an Act of Parliament, for standardizing the education in modern subject of Science, Maths, etc. which are non-theological was proposed in a report of National Conference organized by the National Commission for Minority Educational Institutions (NCMEI). The proposed Board, according to the Report, would award qualifications in modern non-theological subjects which would enable students undergoing instructions in them in schools managed by Madarsas which are voluntarily seeking assistance under the existing Central Scheme of Modern Subjects in Madarsas to gain access to mainstream higher education through equivalence to qualifications from Central Board of Secondary Education (CBSE) and other Secondary or Senior Secondary Boards. The said Conference was attended by various stakeholders, including prominent Muslim educationists, representatives of Madarsa managements and community leaders. It is not a proposal which has been initiated by the Ministry of Human Resource Development. The Government is of the view of that any decision in this regard shall be taken only in the event of there being consensus among all stakeholders.

    (a) Yes. Some hardships were reported and duly addressed.

    (b) Efforts have been made by the Government that only those buildings are hired which are equipped with all amenities required for comfortable stay of the pilgrims in Makkah and Madinah; to enable the pilgrims to get their Haj flights from an airport nearer to their place of stay in India, two more embarkation points vis. Mangalore and Ranchi have been added to this year to the already existing 17 embarkation points and wherever possible larger capacity aircraft are made available for the travel of the pilgrims;

    (c) Haj management is a complex matter where perfect coordination among all the agencies involved is very important. The accommodation for the pilgrims in Makkah and Madinah is arranged by the Haj Committee of India and Consulate General of India, Jeddah, by selecting the buildings with the approval of the Building Selection Teams and Building Selection Committee Teams sent by the State Haj Committees and the Haj Committee of India. Similarly, the Ministry of External Affairs in coordination with the Haj Committee of India makes arrangements for issue of international passports and procuring Haj visas for the prilgrims. The Embassy of India, Riyadh, in coordination with Consulate General of India, Jeddah, and the Haj Committee of India makes arrangements related to transportation etc. of the pilgrims within Saudi Arabia. The Ministry of External Affairs in coordination with Consulate General of India makes arrangements for health care of the pilgrims and also makes other administrative and logistic arrangements for the stay of pilgrims in Saudi Arabia. The Ministry of Civil Aviation makes arrangements for the air travel of the pilgrims between India and Saudi Arabica.
