(a) whether the Union Government has received a Bill titled `Gujarat Control of Organised Crime Bill, 2003` from the Government of Gujarat for approval;
(b) if so, the details and reaction of the Government in this regard;
(c) whether the Government has withheld approval to the Bill;
(d) if so, the reasons therefor; and
(e) the time by which the Bill is likely to be approved?

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)
(a)to (e): The Gujarat Control of Organised Crime Bill, 2003 as passed by the State Legislature and reserved by the Governor for the consideration of the President under article 200 read with article 254 (2) of the Constitution of India, was received in this Ministry on 23.6.2004.
The approval of the Government has not been withheld to the Bill. However, as there is change in the policy of the Central Government, the Central Government is of the opinion that all the subsequent State Legislations should be in line with the Unlawful Activities (Prevention) Amendment Act, 2008, as approved by Parliament.
Hence, the Gujarat Control of Organised Crime Bill, 2003 was returned to Governor of Gujarat on 25.6.2009 together with President’s message dated 24.6.2009 to the Legislature of Gujarat to reconsider it and (i) to delete Clause 16, (ii) to substitute ‘may’ for ‘shall’ after the words Special Court occurring in clause 20(2) and bring the proviso in line with the proviso to Section 43 D (2) of the Unlawful Activities (Prevention) Amendment Act, 2008, and (iii) to amend clause 20(4) to bring it in conformity with Section 43 D (5) of the Unlawful Activities (Prevention) amendment Act, 2008.
The State Legislature reconsidered the Bill in the light of the directives of the President and passed with certain amendments in clauses 1,2,3,15,18,21,23 (inclusion of he word “terrorist act” in appropriate places in these sections) and long title of the Bill and without any amendments in clauses 16 and 20 as suggested in the message of the President.
The Bill viz., the Gujarat Control of Terrorism and Organised Crime Bill, 2003, as passed by the State Legislature and reserved by the Governor for consideration of the President has been received in this Ministry on 11.11.2009.
In the light of the above developments, “ The Gujarat Control of Terrorism and Organised Crime Bill, 2003” is now under further consideration of the Government.

(a)&(b) Yes, Madam. Government of India promotes sports activities through Nehru Yuva Kendras(NYKs) in the country by distribution of Sports material to Youth Clubs and organizing Block and District level Sports Tournaments. A sum of Rs. 1000/- is given to the selected youth clubs for purchase of Sports material. A sum of Rs. 10,000/- is given for organizing Block level tournament, Rs. 20,000/- for District level tournament and Rs. 20,000/- per district for purchase of Sports material for organizing tournaments
(c) to(e) Government of India has also introduced a centrally sponsored scheme titled “ Panchayat Yuva Krida Aur Khel Abhiyan (PYKKA)” in 2008-09 with national coverage for the promotion of basic sports infrastructure and sports competitions in all village and block panchayats of the country. The XIth Five Year Plan outlay for this scheme, which was launched in the financial year 2008-09 is Rs.1500 crores. The scheme envisage to cover around 2.50 lakh village panchayats and 6,400 block panchayats (including their equivalent units) in a phased manner over a period of 10 years at an annual coverage of 10%.

(a) & (b) : The assessment with regard to development of small scale industries (now Micro and Small Enterprises) in the country is a continuous process. It is done through surveys in general and census in particular which reflect the time scale data indicating the quantum of growth/development. The quick results of 4th Census of the micro and small enterprises (manufacturing) which pertains to the period 2006-07 indicate that there is 7.37 percent growth in the number of units, 9.09 percent in the employment and 15.62 percent in the exports as compared with that of 3rd Census (2001-02). The summary of the above is annexed.
(c)& (d): A large number of micro & small enterprises in the country are characterized by low levels of technology. The government is, however, promoting technological upgradation through its scheme like Credit Linked Capital Subsidy Scheme (CLCSS) and schemes under the National Manufacturing Competitiveness Programme.

(a) to (d): The Ministry is engaged in consultations with the different stakeholders with a view to build a consensus on the draft of the Broadcasting Services Regulation Bill, 2007, which is available on this Ministry’s website www.mib.nic.in. Consultations were required in view of the concerns expressed by various sections in the media with respect to the need, scope, functional and financial autonomy and independent functioning of the Regulator as proposed in the Draft Bill 2007.
The draft Bill was also circulated to the States and Union Territories to elicit their views. The comments have since been received from 18 States and 6 UTs. The issue was also taken up for discussions in the 26th & 27th State and Union Territory Ministers for Information and Cinematography Conference (SIMCON) wherein most of the States have expressed their agreement with the provisions of the Bill and the need to set up an independent and autonomous Broadcasting Authority.
The draft Bill has been discussed in various fora from time to time, however, no consensus could emerge. With a view to carry forward the consultations in a structured format, Government has constituted a Task Force on 27.11.2009 headed by Secretary (I&B) with two representatives each from the Indian Broadcasting Foundation, News Broadcasters Association and Broadcast Editors Association. Joint Secretary (Broadcasting) is the member convenor of the Task Force. The Task Force has been entrusted the work of holding consultations with different stakeholders including but not limited to academicians, media experts, civil society/consumer organizations, associations of other broadcasting associations including Multi System Operators, Cable operators, Direct-to-Home association, Internet Protocol Television forum, Association of Radio Operators, editors of newspapers, legal luminaries, organizations representing the interests of women and children to understand their perspective on the need, scope, jurisdiction, organizational structure, powers and functions of an independent Broadcast Regulator and the issues relating to regulation of content. The Task Force would also consider the recommendations made by the various Committees of Parliament. The Task Force has held three consultations since and three more consultations are scheduled on 15.03.2010, 22.03.2010 and 29.03.2010.

(a) to (e) The current nuclear power capacity of 4340 MWe can be increased to about 15,000 MWe by the year 2020 by completion of ongoing projects and indigenous efforts. Another 10,000 MWe can be added by the year 2020 through international cooperation with France, Russian Federation and the USA.
Setting up of a total of 40,000 MW capacity through international co-operation in nuclear power is possible but in a longer time frame beyond 2020. The project details have not been finalized. The investment is expected through a combination of equity, domestic & foreign borrowings and intergovernmental credit.

MINISTER OF THE STATE IN THE MINISTRY OF FOOD PROCESSING INDUSTRIES (SHRI SUBODH KANT SAHAI)
(a) & (b): Yes Sir. The Government of India has set up National Meat and Poultry Processing Board (NMPPB) on 19.02.2009 to give boost to the Indian meat and poultry industry and to bring it up at par with the global quality standards.
(c): The NMPPB has organized two conferences/seminars/workshop/meat workers training i.e. one at New Delhi and another at Nammakal & Tiruchengode during the months of November, 2009 and December, 2009 respectively to create the awareness among the stakeholders on the need of developing the industry in a scientific manner so as to ensure the supply of good quality and hygienic meat to the consumers. Moreover, The NMPPB has also participated in national as well as international exhibitions to promote the activities of the Board. The setting up of a Food Testing Laboratory at New Delhi is also in process so as to ensure that they meet the food safety standards. This laboratory would be commenced by 31st March, 2010. The Board has also drawn short term as well as long term action plans to achieve the objectives of the Board for which it has been established. The main action plans, inter-alia, includes Capacity Building-training of Supervisors/officers of Municipal Commissioners/State Governments and workers engaged in Meat & Poultry sector, 360º Awareness Campaign, Research & Development. Standardization of meat shops, Meat workers (Butchers) welfare programme, etc. A panel of consultants for the sector is also being prepared by the Board. The Board is also taking steps to standardize the technology, equipments and cost of various sizes of slaughter houses keeping in mind to make the slaughter houses more environment friendly and non-polluting as well as full commercial utilization of the by-products.
(d): Ministry of Food Processing Industries extends financial assistance in the form of grant-in-aid @ 25% of the cost of plant & machinery and technical civil works subject to a maximum of Rs.50 lakhs in general areas or 33.33% subject to a maximum of Rs. 75 lakhs in difficult areas under the Scheme of Setting up/Modernization/ Expansion of food processing industries including meat processing units.

(a) to (c): As per data compiled by Bureau of Police Research & Development (BPR&D), the total sanctioned and actual strength of police forces as on 1.1.2008 and number of vacancies State-wise, including Delhi Police is at Annexure-I. The consolidated rank-wise total sanctioned strength, actual strength of police personnel and vacancy position as on 01-01-2008 is given at Annexure-II.
(d) & (e): No, Madam. The recruitment of State police personnel (except IPS) is not done by the Central Government.
(f) & (g): Yes, Madam. A project on Transparent Recruitment Process (TRP) developed by a Micro Mission under the National Police Mission has been cicrculated by Bureau of Police Research & Development (BPR&D) to Directors General of Police (DGP)/Inspectors General of Police (IGP) of States/UTs on 18-09-2009. This was followed up with a reference dated 16-11-2009 and was also reiterated in the Chief Ministers’ Conference on 07-02-2010 by Union Home Minister to Chief Ministers of States highlighting the importance of the project and urging them to adopt the TRP for early implementation.
(h) &(i): As per the response received from State Governments, the State of Uttar Pradesh has already implemented the process in full. Andhra Pradesh and Tamil Nadu already follow a TRP. In Bihar, many features of TRP are already being followed. Several other States like Chhattisgarh, Haryana, Himachal Pradesh, Jammu & Kashmir, Jharkhand, Karnataka, Maharashtra, Orissa, Punjab and Rajasthan have informed that the matter is being examined/processed by them. The recruitment to State Police is done by the States themselves and no funds are sanctioned by the Ministry for the purpose to States.

(a) to (b): Though the ICAO has issued guidelines for issue of Machine Readable Passports (MRPs) by April 2010, there would be no ban on the travel of hand-written passport holders till 2014.
(c) to (d): The MRPs were introduced in India in July 2000. All the Passport Offices and the Indian Missions/Posts abroad issue MRPs. However, biometric passports have been introduced only in the Diplomatic and Official category in June 2008. The roll-out of biometric passports in Ordinary category is under process.

(a) & (b): No Madam, India’s merchandise exports have consistently increased during the last few years. Merchandise exports of principal commodities from India during the last 3 years are given in Annexure I. However, during the current financial year 2009-10, there has been a decline in exports as compared to last year 2008-09.
(c) to (f): The Government and RBI closely monitor the economic developments in the country and internationally on a continuous basis and need based measures are taken, from time to time, keeping in view the financial and overall economic implications. Some of the steps taken by Government and RBI are given in Annexure II. Further, subsequent to announcement of Foreign Trade Policy (FTP), 2009-14, Government had carried out a sectoral performance review of export product groups in the wake of continued impact of global economic slowdown. Accordingly, additional support measures were announced in January / February, 2010, primarily for those sectors which still continue to show significant decline in exports. This is with a view to enhance export competitiveness of these products and provide support for market diversification. The complete details of the products and countries / markets for which incentives have been announced are in public domain and can be downloaded / seen from the website http://dgft.gov.in.
There has been progressive reduction in the rate of decline in export growth in dollar terms from May, 2009 to October, 2009, and monthly exports have turned positive since November, 2009, which clearly indicates that all the measures and initiatives taken by the Government and RBI have had a significant impact on effecting a turnaround in our exports.
(g): Government monitors and reviews the policy and the procedure laid there-under, for simplification and transparency in its operation, on a continuous basis.

(c)&(d)Recognizing the new developments in biotechnology, the Department of Biotechnology, Ministry of Science and Technology jointly with the Ministry of Health and Family Welfare had established five project based centres for detection of Genetically Modified (GM) foods with special reference to cotton, soyabean, corn, brinjal, tomato, rice, peanut, mustard, papaya and potato. These projects are implemented at Central Food Technology Research Institute, Mysore, Centre for DNA Fingerprinting and Diagnostics, Hyderabad, Industrial Toxicological Research Institute, Lucknow, National Bureau of Plant Genetic Resources, New Delhi and National Institute of Nutrition, Hyderabad. For toxicological analysis of GM crops, a project has also been implemented at Shriram Institute for Industrial Research, New Delhi. In order to facilitate regulation, field testing and validation of transgenic crops developed in public research funded programmes, a Platform for Translational Research on Transgenic Crops has also been established at ICRISAT, Hyderabad.
(e)&(f) The Ministry of Health and Family Welfare has notified the Food Safety and Standards Authority of India (FSSAI) under the Food Safety and Standards Act, 2006 to regulate genetically modified foods, organic food, functional foods, etc. FSSAI is in the process of putting in place necessary framework and mechanisms to regulate GM foods.

(a) & (b): In accordance with the ICAO guidelines to incorporate biometrics data in the Machine Readable Travel Documents, India has decided to upgrade its existing passports to electronic category i.e. e-passports. Accordingly a pilot project for issue of e-passports in the category of Official and Diplomatic e-passports was launched on 25th June 2008. Based on the experience gained through the pilot phase of issuance of e-passports in the diplomatic and official categories, the issuance of e-passports in the ordinary category has been taken up by the Government. The e-passports have an embedded electronic contact-less chip containing relevant data about the passport holder.
(c) to (f): Since the e-passports have enhanced security features, the cost is likely to be higher than that of the existing ones. However, the fees to be paid by the applicants for issue of the e-passports will be determined only after all input costs are assessed.

Department of Pharmaceuticals has already taken up the matter with Department of Revenue of exemption of all anti cancer drugs from custom duty/counter veiling duty.
(d) & (e) : Under the existing National Cancer Control Programme (NCCP), the Central Government is supplementing the efforts of the State Government by providing financial assistance to Government Medical Colleges/Institutions. Financial assistance up to Rs. 3.00 crore is provided for setting up Radiotherapy Units in Government Medical Colleges/Hospitals for providing treatment facilities. A one time financial assistance of Rs. 5.00 crore is also provided to Government Medical Colleges/Hospitals which are recognized as new Regional Cancer Centre for upgrading the facilities including civil construction and purchase of equipments.

The rehabilitation schemes for Ex-servicemen at present relate to training, re-employment in Government as well as non Government sectors and self employment schemes such as Coal Transportation, Coal Tipper, Oil Product Agency, Allotment of BPCL, GHAR outlets, Mother Dairy Booths, Management of CNG Stations and management of Toll Plazas. Army Welfare Housing Organisation (AWHO) as a welfare measure is constructing houses for the serving/retired personnel of the army and their widows on a “No Profit No loss basis”. Presently approx 20,000 houses have been constructed at 34 different stations, and another approx 3,400 houses are under construction at another 12 stations. In addition approx 6500 houses are under planning at fourteen stations.
(d) Reservations in jobs for ex-servicemen in Group C & D posts have been provided in Central Government jobs, Public Sector Enterprises, Public sector Banks and Financial Institutions. Additionally, reservation for ESM is also provided at the intake level of Assistant Commandant in all para military forces and 100% reservation is provided to Ex-servicemen in Defence Security Corps.

Government constantly reviews the security environment and accordingly decides induction of appropriate equipment including submarines for Navy. This is a continuous process undertaken for the modernization of Armed Forces to keep them in a state of readiness to meet any eventuality. Acceptance of Necessity for the construction of additional submarines under Project-75 (India) has been accorded. The proposal is being progressed. A programme for construction of six submarines is currently underway at M/s. Mazagon Docks Limited. In addition, efforts are made to maintain force-level by upgrading/modernizing the existing assets.
Government has not entered into agreement with foreign countries for procurement of submarines in the recent past.

(a) to (d): No. The Government does not propose to privatize the passport offices. The Government has embarked on a Mission-Mode Project titled “Passport Seva Project”, approved by the Cabinet, to comprehensively transform passport service delivery under the network of existing Passport Offices. The basic design involves outsourcing of non-sensitive front-end activities to a service provider and retaining sovereign and sensitive functions with the Government. Under the Project, 77 Passport Seva Kendras (PSKs) are proposed to be set up across the country. Each PSK will be headed by an officer from the Central Passport Organization. There will be dedicated Data Centre, Disaster Recovery Centre, Central Passport Printing Facility and Network Operations Centre for the Project. These assets in addition to Application Software and System Software will be owned by the Government to have the strategic control over the Passport Seva System.
(e): The Central Passport Organisation employees have conveyed their no objection with certain observations.
(f): Implementation of the Project is expected to result in delivery of passport-related services to the citizens in a timely, transparent, more accessible and reliable manner and in a comfortable environment through streamlined processes and a committed, trained and motivated workforce.

(a) to (e) Coffee and Tea are grown under eco-friendly conditions in the country including in bio-sensitive regions under suitable agro-climatic conditions. Indian organic standards are notified under the National Programme on Organic Production (NPOP) and have been granted equivalence by the EU, Japan and USA. Therefore, organic products certified as per Indian standards can be exported to these destinations without further certification. It is the Government’s endeavour to preserve the eco-friendly character of organic coffee and tea plantation in various States including Kerala. The respective Boards are encouraging the cultivation of organic coffee/tea and conservation of bio-diversity by vigorously promoting the same among interested growers through training workshops and demonstrations.

c) In 2008, India’s share in US dollar term is about 1.35% in export of agricultural products in the international market.
d) Encouraging export is a continuous process. The Government is taking steps to encourage export of agro products through measures and incentives under Plan schemes of the Commodity Boards and Export Promotion Councils. Further, in order to boost export of Indian products, the Ministry of Commerce & Industry has put in place various schemes namely Market Development Assistance (MDA), Market Assistance Initiative(MAI), Assistance to States for Developing Export Infrastructure and Allied Activities(ASIDE), Vishesh Krishi and Gram Upaj Yojana, Focus Product Scheme, Focus Market Scheme, Town of Export Excellence, etc. Trade delegations are sent abroad and Buyer-Seller meets are organized in this direction.

(a): The stocks of sugar are maintained by sugar mills, importers and traders. Hence, it is not possible to indicate the quantum of stocks of sugar. The quantum of sugar allocated to State Governments/UT Administrations during last three sugar seasons and the current sugar season is indicated below:

(b) & (c): In the recent past, the Union Government has received requests from Government of Kerala and Assam for additional allocation of levy sugar for festivals. The Government of Uttrakhand requested additional allocation for Maha Kumbh Mela. The Government of Tamil Nadu requested for increase in the allocation of levy sugar of the States corresponding to the enhancement of levy percentage from 10% to 20%. The Government of Bihar requested for enhancement of their levy sugar quota. During the Chief Ministers meeting held on 6.2.2010, Mizoram requested for raising the current allocation from 666 MT to 800 MT per month; Andhra Pradesh requested for increase in allocation so as to ensure that card holders get at least 1 kg per month; and Orissa requested for allocation of sugar for APL families also at subsidized rate.
In February, 2001, the Central Government restructured supply of levy sugar for distribution under Public Distribution System (PDS) and restricted its supply to Below Poverty Line (BPL) families throughout the country except the North Eastern States, Hill States and Island territories where universal coverage was allowed. This was done with a view of better targeting of PDS beneficiaries.
The Central Government has not accepted the request for additional allocations. However, the monthly levy sugar quota of Bihar State has been restored in full with effect from April, 2010.
(d): No, Sir.
(e): Does not arise.
(f): At present, the Central Government is following policy of partial control of sugar under which a part of sugar production is requisitioned as levy sugar (at present 20% for 2009-10 sugar season) for distribution in the PDS at a uniform retail price and rest of the production is allowed to be sold as non-levy sugar subject to regulated release mechanism policy.

(a)to(d)Two Members and one Special Invitee of the Genetic Engineering Approval Committee (GEAC) out of seventeen members and two special invitees did not support the decision of the GEAC on Bt brinjal. Bt brinjal event EE-1 has been developed in compliance with the prevailing regulatory procedures and biosafety guidelines. The decision of the GEAC on the safety of Bt brinjal for environmental release is based on
(i) review by three high level technical Committees namely; the Review Committee on Genetic Manipulations and two Expert Committees constituted by the GEAC in 2006 and 2009;
(ii) scientific facts/data generated during 2002-2009; and
(iii) international experience with GM crops. Subsequently, based on the views of various stakeholders during the public consultations organized by the Ministry, moratorium has been imposed on commercialization of Bt brinjal until independent scientific studies establish, the safety of the product from the point of view of its long-term impact on human health and environment, including the rich genetic wealth of brinjal existing in our country. The GEAC has been requested to address the concerns for resolving all scientific issues relating to Bt brinjal.
(e)to(h)The allegations regarding violation of the Biological Diversity Act , 2002 in the context of Bt. brinjal, case are misplaced and unjustified. The import of transgenic material does not fall under the purview of Biological Diversity Act Biological Diversity Act. Guidelines and procedures are in place under this Act for transfer of biological material from India and for international collaborative research.

(a): Yes, Sir.
(b): The Indian High Commission in Australia and the Consulates General in Melbourne and Sydney each have a Community Welfare and Student Liaison Officer (CWSLO) who is on call 24 by 7, and whose mobile number is on the Indian High Commission’s website as their emergency response number. Any problem involving an Indianstudent or member of the community, is handled by the CWSLO in coordination with the High Commissioner/ Consuls General. There is also a policy of `Open Fridays`, when any student can walk into the Chancery without an appointment and meet the concerned officer to discuss any problems. In addition, the students are given information brochures, and details regarding fair wages. Detailed guidelines have also been placed on the website of the High Commission as well as the Consulates, which are being regularly updated. The High Commission and the Consulates also provide whatever assistance it can in specific cases, such as legal aid, medical treatment, temporary accommodation, psychological counselling, intervention with the educational authorities or employers as the case may be, in co- operation with local governments and community services.
(c): 86 students have approached since August 2009 in person. Besides that a number of students have contacted the High Commission and Consulates through e-mail and phone for assistance, which were duly attended to.
(d): The Indian High Commission and the Consulates have been taking up the incidents of assaults on members of Indian community including students with the Australian authorities, at federal and State levels. The High Commissioner held several meetings with the concerned Ministers as well as senior officials to discuss the matter.
The Minister of Human Resource Development, during his visit to Australia from 6th to 10th April 2010 held extensive discussions with various dignitaries from the federal as well as State Governments of Australia regarding the safety and well being of Indian students in Australia. The Minister urged the Australian authorities to take stringent measures to stop such attacks and also to apprehend the culprits in recent incidents. The Minister also stressed the urgent need to set up an institutional mechanism for sharing of information on such incidents.

The Government has approved setting up of six AIIMS-like institutions in the States of Bihar (Patna), Chhattisgarh (Raipur), Madhya Pradesh (Bhopal), Orissa (Bhubaneswar), Rajasthan (Jodhpur) and Uttarakhand (Rishikesh) under the first phase of Pradhan Mantri Swasthya Suraksha Yojana (PMSSY). The Government has also approved setting up of two more institutions, one each in the State of Uttar Pradesh and West Bengal in the second phase of PMSSY.
