Order reserved on excise commissioner’s bail plea

New Delhi : A special Central Bureau of Investigation (CBI) court here Friday reserved its order on the bail plea of Central Excise Commissioner A.K. Srivastava allegedly involved in a graft case.

Special CBI Judge Talwant Singh reserved his order for March 6.

According to the CBI, a central excise team led by Central Excise Superintendent Lallan Ojha conducted a surprise raid at the warehouse of Dilip Aggarwal and Anand Aggarwal but then negotiated a deal for illegal gratification. The court Thursday had cleared the way for trial of Ojha, the two businessmen and a middleman.

The court, however, did not take cognizance of charges against Srivastava as the sanction from the concerned authority to prosecute him was still awaited.

In his bail application, Srivastava has requested court to release him taking note of his health since he is undergoing treatment in jail hospital after angioplasty procedure recently.

Srivastava’s counsel told the court that his client’s son is appearing for board examination and there is no one to take care of his aged mother.

Counsel also added that Srivastava is posted outside Delhi now so he could not tamper with evidence in the case.

The CBI opposed his bail plea, telling the court that Srivastava’s health is stable. The probe agency added that if he was released on bail, he could tamper with the evidence.

The court last month rejected the bail plea of the excise commissioner, accepting the probe agency’s submission that he masterminded the scam.
