Hyderabad: Majlis-e-Itehadul Muslimeen (MIM) Chandrayangutta MLA and Legislative Assembly floor leader Akbaruddin owaisi, Malakpet MLA Ahmed Balala, his gunmen Mohammed Jani, Barkas area MIM councilor Mansoor Awalgi and three others are booked in the murder case by Chandrayangutta Police in connection with the killing of Ibrahim bin Younus Yafai.
Ibrahim Yafai was allegedly in the gang which made an assassination attempt on Akbaruddin Owaisi April last year. Ibrahim Yafai was killed by the gun shots fired by Mohammed Jani, who is the bodyguard of Ahmed Balala. Akbaruddin Owaisi survived miraculously but with life threatening injuries.
On 4th August 2011, Andhra Pradesh High Court while listening to the bail application of Mohammed bin Omer Yafai alias Mohammed Pehelwan (uncle of Ibrahim Yafai and major accused in Akbaruddin Owaisi assassination attempt case) ordered the police to register Murder case against Akabruddin owaisi and others to investigate the death of Ibrahim Yafai, on this account central crime station registered a criminal case No. 256/2011.
But the Supreme Court while cancelling the bail of major accused in the case, declared the High Court’s order null and void, and asked the family members to register a fresh case.
Awad Yafai brother of Ibrahim yafai who himself sustained bullet injury, after getting bail, made a complain on 3rd September 2012 to the commissioner of police, DCP south zone and Chandrayangutta Police Station against Akbaruddin owaisi and others for allegedly killing his brother. Police then moved for an advice from the A.P. public prosecutor in the case.
In his complain Awad Yafai has alleged that Akbaruddin Owaisi called their family into the MIM party office at Barkas and threatened them with a gun, and during verbal arguments clash broke out between both groups.
On 9th of this month Awad Yafai approached the High Court and filed a writ petition against the police for not registering a complaint, he alleged that police is acting in bias manner and even after one month of filing a complaint a case is not registered.
When High Court issued a notice to the city police in this matter, yesterday the public prosecutor presented the memo of Chandrayangutta police station which claimed F.I.R. is being registered in the complain of Awad Yafai. The case is registered under Sections 147 (rioting), 148 (rioting armed with deadly weapon), 302 (murder), 326 (grievous hurt), 506 (criminal intimidation) and 120-B (criminal conspiracy), and Section 27 of Indian Arms Act.
