Arrest warrant against BJP’s Subramanian Swamy by Assam court

Guwahati/New Delhi: A court in Assam has issued a non-bailable arrest warrant against senior BJP leader Subramanian Swamy for failing to appear before the court despite being issued a summons.

The warrant was issued on Monday when Swamy was summoned for making ‘derogatory’ statement on mosques and churches during his visit to the state recently.

The BJP leader, however, approached the Supreme Court on Tuesday challenging the issuance of non-bailable warrants against him by the Assam court. The apex court asked Swamy to first complete all the procedural requirements in the court’s registry before mentioning the matter.

The Karimganj district had court issued the order following a complaint registered by advocate Tutiur Rahman Patikar for hurting the sentiments of the Muslim and the Christian community.

Shah Saiyad Ahadur Rahman, additional CJM (Karimganj), in his order, said Swamy should be arrested on or before June 30. The order also asked the Delhi and Assam police to arrest him and produce before the court.

Earlier, the court had issued summons asking Swamy to appear before the court on May 6.

During a visit in March this year, Swamy had reportedly said that mosques and churches are mere ‘buildings’ to offer prayers. “So there is no problem in demolishing them. They demolish mosques even in Saudi Arabia,” he had said. He further said that god lives only in temples.

He also made some other statements which evoked sharp reactions across the region. Swamy had said that if an illegal Muslim immigrant was ready to convert to Hinduism then he could be allowed to stay in India.

Assam Police had registered an FIR against Swamy at Latasil police station in Guwahati under sections section 120(B) (criminal conspiracy), 298 (Uttering words with deliberate intent to wound the religious feelings of any person), 153(A) (Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language) of IPC following a complaint by Chatra Mukti Sangram Samiti, students wing of Krishak Mukti Sangram Samiti (KMSS), a peasants’ organization of the state.

Following this, the Assam chief minister even warned the BJP leader of barring him from visiting the state. “His comments are completely insulting for a community. We will take action. If he continues to talk like this, we will ban his entry into Assam,” chief minister Tarun Gogoi had said.

Besides, several organizations and students’ bodies also appealed for a ban on Swamy.

Meanwhile, Swamy on Tuesday moved the Supreme Court challenging the issuance of non-bailable warrants against him by the court in Assam over his controversial comments. A vacation bench of Justice Prafulla C Pant and Justice Amitava Roy asked Swamy to first complete all the procedural requirements in the court’s registry before mentioning the matter.
