Abdul Qadeer in prison for 22 years: NHRC seeks report from AP Govt.

Hyderabad: The National Human Rights Commission has asked Andhra Pradesh government to submit within four weeks a report about the case of Abdul Qadeer who is in prison for 22 years. NHRC sent notice to the Chief Secretary of Andhra Pradesh on 18th June acting on the complaint filed by Civil Liberties Monitoring Commttee of India on 23rd May and sought action taken report on the complaint.

“The complaint dated 23/05/2012, was placed before the Commission on 18/06/2012. Upon perusing the complaint, the Commission directed as follows. Transmit the complaint to the Chief Secretary, Government of Andhra Pradesh calling for Action Taken Report within four weeks.
Accordingly, I am forwarding herewith a copy of the complaint for taking appropriate action in the matter as per the directions of the Commission. It is requested that an Action Taken Report be sent to the Commission within 4 weeks from the date of receipt of this letter,” reads the notice signed by Assistant Registrar (Law) of NHRC.

CLMC in its letter to NHRC had provided details about Abdul Qadeer who is in jail for 22 years even after serving life sentence.

“Since 1990 Adbul Qadeer is languishing in jail. During communal riots, Abdul Qadeer who was a police constable, at that time observed that his superior officer gave firing order on the innocent people. Unable to see the injustice of his superior officer, he took out his gun and fired at that officer. Due to which he expired. After that Abdul Qadeer surrendered himself before the police. After his surrender, police tortured him in inhuman manner. At that time communal hatred was on its peak. And the total hatred against Muslims was taken out on Abdul Qadeer. Later when he was produced in the court he was injured severely. He stated in the court of Law that it was an emotional act because he was unable to bear the killing of innocent people by a police officer whose duty is to protect the life of the people.

The Court gave him life imprisonment. Since then he is in jail. He was put in several jails such as Rajahmundry, Visakhapatnam, Warangal and now he is in Cherlapally jail. Even in jails he was discriminated badly. He was put in high security and egg-shaped cell. Even in jail he was continuously harassed and tortured. He was beaten by other inmates’ especially non-Muslim inmates. It is also known that a family member of the officer, whom Abdul Qadeer fired at, had beaten him mercilessly with iron rods due to which his hand and leg got badly injured. The same leg was not cured completely and he also became diabetic, the condition went worse and now its condition is that the doctors have advised him to mutilate that leg.

He completed sentence in the year 2004. But still he is languishing in jail. His health has deteriorated to such an extent that he looks much older that his age. At present he is suffering with many diseases such as mental depression, heart disease, diabetes, Blood Pressure etc for which he was hospitalized many times. From the past four years he is not even released on parole in recent years, except on his mother death.”

CLMC had urged the NHRC to intervene in this matter as this is a very important case and the matter of life and death of Abdul Qadeer. “At least in his last days of his life, he should be allowed to spend time with his family. He has suffered more than what he was ought to. Kindly take immediate action and instruct the AP government to release Abdul Qadeer immediately,” CLMC has demanded.
