“Allegations against him and others in my book have SC backing”, says Akshardham acquitted man on Vanjara’s suit

Mumbai: Mufti Abdul Qayyum, acquitted in the Akshardham terror case, and Jamiat Ulama-e-Hind have reacted strongly to D G Vanjara’s Rs 101 crore suit filed against them for writing and publishing book that criticizes Vanzara and other police officials for booking Qayyum in the case.

Retired IPS officer DG Vanzara, charge-sheeted in fake encounter cases of Sohrabuddin Sheikh, his wife Kauser Bi, Tulsiram Prajapati and Ishrat Jahan, on Monday filed Rs 101 crore suit against Qayum for derogatory writing against him in his recently penned book “11 months after spending 11 years in jail.”

In this autobiography, Qayum has revealed a shocking case of intrigue, ruse, torture and deceitful framing. The book indicated a dangerous over zeal of police that prompts them to frame innocent people and thereby defame Gujarat police.

Vanzara, who investigated the matter then and is currently out on bail while being confined to Mumbai as per his bail condition prescribed by the court in both – Sohrabuddin and Ishrat cases, filed a defamation case against Qayyum seeking damages of Rs 101 crore.

Other respondents named by Vanzara are Jamiat-e-Ulema of Maharashtra, Jamiat-e-Ulema of Ahmedabad, Madrassa Tarbiyatul Atfal of Ahmedabad, Rasulbhai Moonlight and Maulvi Nizammudin.

“Qayum’s book is a part of a larger conspiracy to discourage other patriotic police officers who fight against terrorism. It is nothing but an attempt to victimise me. This book contains stories which are totally false, baseless, anti-national and defamatory in nature,” Vanjara’s petition says.

Reacting to the news of Vanjara filing defamation against him, Qayum told TwoCircles.net, “We have not received the notice as yet. Our legal panel will decide on the course of action once we receive the notice. But I can say that before I wrote the book, Honorable Supreme Court itself ruled that police investigation in Akshardham case is fabricated and innocents are framed in the case. Can Vanjara deny SC findings?”

“If Vanjara can sue me of Rs 101 crore for allegations I penned against him in my book, then even a novice can imagine how much he and the state must compensate me for destroying 11 precious years of my life,” he added.

“My innocence is established by the Supreme Court and on the basis of it, I have petitioned SC for compensation where D G Vanjara, Gujarat state and some other officers are parties. The petition is already admitted by the SC and notices have been issued. I am confident that I will get relief from SC,” he said when asked about the status of his petition before the apex court.

The Supreme Court in its judgment dated May 16, 2014 had pulled up the investigation agency and finally proclaimed: “…Instead of booking the real culprits responsible for taking so many precious lives, the police caught innocent people and got imposed the grievous charges against them which resulted in their conviction and subsequent sentencing.”

Mirza Sahib, a functionary from Gujarat chapter of Jamiat-e- Ulama Maharashtra considers Vanjara’s suit as a counter strategy to Qayum’s petition before Supreme Court. “We are an NGO and help falsely implicated men from our community. We have a strong expectation from the SC over Mufti sahib’s (Qayum) compensation petition as the apex court is giving patient hearing, admitted it and issued notices. Vanjara’s suit is simply an attempt to counter our petition there (SC),” he told TwoCircles.net.

When asked what will be Jamiat’s response to the suit, he said: “We are not bothered with the suit filed by him (Vanjara). Rather it implies that when a police officer can sue of Rs 101 crores for a book, then the compensation amount that Mufti Sahib (Qayum) should get must be much much higher as he lost 11 years of his life due to fabricated investigation.”
