No certification needed for minority status of minority educational institutions

New Delhi: Famous lawyer and President of the Supreme Court Bar Association, P. H. Parekh has informed that if people of the minority community open educational institution for the betterment of their community then no certificate is needed from the Government for its minority status since it will be automatically a minority institution.

He said this while delivering a lecture in Institute of Objective Studies (IOS) on the topic of minorities. “The article 30 of Indian constitution gives the right to minorities to open and manage educational institution, the Government have no right to interfere in its self governance” he opined.

Government can not take any institution under its control by giving aid to the institution.

Dr Parekh said by stressing that the special rights of minorities under article 30 is a part of basic structure of Indian constitution and it can’t be changed by any law.

“Any resolution which contradicts the basic rules of Indian constitution passed in the state assemblies or Parliament, the court can easily reject them therefore it must be challenged in the court if such a resolution passed” he said.

The President of Supreme Court Bar Association also gave a cheque of Rs 1 lakh to the education scholarship fund of the IOS.

He appealed to the management of the institution to give increase scholarships given to the poor students to make sure that none of the student remain uneducated due to lack of money.

Addressing on this occasion Dr Manzoor Alam, Chairman of the IOS said that Muslims should use the rights provided by the constitution to ensure the bright future of the community. He added that the constitution has given us a weapon and power in the form of article 30 which must be used.

Saying that the Right to Information (RTI) Act is a new and very beneficial reward of Indian Constitution, he expressed his disappointment on lack of use of this particular act by the Muslims.

Established in 1986, IOS is involved in empirical and conceptual research of Muslims of India and other minorities.

Article 30 of the Indian Constitution:

30. Right of minorities to establish and administer educational institutions.-

(1) All minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.

[(1A) In making any law providing for the compulsory acquisition of any property of any educational institution established and administered by a minority, referred to in clause (1), the State shall ensure that the amount fixed by or determined under such law for the acquisition of such property is such as would not restrict or abrogate the right guaranteed under that clause.]

(2) The State shall not, in granting aid to educational institutions, discriminate against any educational institution on the ground that it is under the management of a minority, whether based on religion or language.
