Court rejects petition against land acquisition

New Delhi : The Delhi High Court Tuesday dismissed the petitions by landowners in west Delhi challenging a 1999 notification for acquisition of their land for a residential scheme.

The court upheld the notification of the Delhi Lt. Governor for taking over the land for the Rohini Residential Scheme, under the planned development of Delhi.

A division bench of Justices Vikramjit Sen and J.P. Singh, dismissing the petitions, said such schemes were for the people and should not be challenged.

"Section 17 of the Land Acquisition Act deals with the urgent action leading to expropriation of private property. It empowers the state to take possession of lands required for public purposes," the bench said.

It also dismissed another batch of petitions challenging the government's 2003 notification for acquisition of land in the villages of Begumpur, Rani Khera, Pansali and Mahamudpur Maijri in Rohini.

The court imposed a cost of Rs.5,000 on each of the petitioners saying that they filed the litigation with the motive to delay completion of the residential project in Rohini.
