Tokyo : The Supreme Court of Nagoya City Thursday ruled unconstitutional the sending of Japan’s Self-defence Forces to Iraq, in the first judicial sentence pronounced in the country in relation to the issue.
The mission of those troops in the Arab country is against the peaceful Japanese Constitution in force since the Second World War, said Judge Kunio Aoyama, when referring to article 9 of the Constitution.
According to that article, the Japanese people renounces to war as a sovereign right and the use of force as a means to solve international war conflicts.
In that sense, the judge said that the Japanese Self-defence forces back other countries in the war against Iraq, so it can be considered that the archipelago is making use of force.
The sentence passed by the Nagoya Court responds to a demand presented by a group of fellow citizens who condemned the sending of Japanese troops to Iraq.
