New Delhi : The Delhi government Monday approved an ordinance to provide for smoother functioning of the Municipal Taxation Tribunal.
The Lieutenant Governor of Delhi would promulgate the Delhi Municipal Corporation Act (Amendment) Ordinance, 2008 after obtaining instructions from the president.
“An ordinance would be promulgated to make provisions for procedure to be followed by the existing municipal taxation tribunal for disposal of its functions. It has been decided to amend sections 169, 170 and 171 of the DMC Act, 1957,” Chief Minister Sheila Dikshit told reporters after the cabinet meeting.
A Delhi government official explained: “Section 169, which was first amended in 2003 is being further amended to make provisions for smooth functioning of the Municipal Taxation Tribunal, which was constituted in 2007 for hearing appeals against levy or assessment or revision of assessment of any tax under the Act after introduction of the Unit Area Method of Assessment of Property Tax.
“As no formal provision exist in law regarding the procedure to be followed by the Tribunal for its functions which are mainly judicial in nature, it is necessary to provide a proper legal back-up to the procedure to avoid any legal complications in future,” the official added.
Amendment to Section 169 would make provision for appointment of a registrar and other staff for the Tribunal and vest in it limited powers of a civil court, he said.
He added that a few more amendments of minor character were being effected in Sections 170 and 171 as they are required for the smooth implementation of the Act.
