‘India needs a universal child custody law’ says leading advocate

London : India should enact a universal child custody law adhering to principles laid down in the Hague Convention to address the increasing problem of parental child abduction, a leading Indian advocate has said.

“It is important to create a uniform policy of law, some clear, authentic and universal child custody law adhering to the Hague Convention and enacted within India,” Anil Malhotra, the sole advocate speaker invited from India told 73rd Biennial Conference of International Law Association in Rio De Janeiro, Brazil.

Malhotra, while speaking at a session on “Rights of Children: International Cooperation in the fields of Maintenance, Adoption, Custody and Abduction” noted, “as the number of Non-Resident Indians abroad increasing which is about 25 million at present and multiple problems leading to family conflicts, inter-parental child removal to India now needs to be resolved on an international platform.

“It is no longer a local problem. The phenomenon is global. And steps have to be taken by joining hands globally to resolve these conflicts through the medium of Courts interacting with each other. Till India does not become a signatory to the Hague Convention, this may not be possible.”

The conference was attended by over 500 lawyers, academics and judges from about 40 countries. The Chief Justice of India K G Balakrishnan led a 15-ember delegation to the conference. Balakrishnan also chaired a session on “Implementation of International Systems of Human Rights Protection into National Legal Systems”.
