A division bench comprising Chief Justice Swatanter Kumar and Justice J.P. Deodhar found the central government’s decision “arbitrary”, and observed that the government failed to explain that the extension was granted in public interest.

The court’s ruling came on a public interest petition filed by two citizens R.R. Tripathi and Gaurang Damani, who challenged the extension to the two police officers.

The duo was due to retire Nov 30, 2007, when the state government recommended an extension, which was approved by the central government. The extension will expire Feb 29.

The court has stayed operation of its order for the next three weeks.
