Hospital ordered to pay Rs.100,000 for medical negligence

New Delhi : A city court Tuesday slapped a fine of Rs.100,000 on a hospital run by the Municipal Corporation of Delhi (MCD) for negligence in a sterilisation surgery that led to the birth to unwanted child.

The case dates back to 1987 when Nirmala and her husband Mahavir, who had two children, went to the Girdharilal Maternity Hospital at Ajmeri Gate for sterilisation following an advertisement in a local daily about the government’s family planning drive.

However, Nirmala became pregnant after some months. The couple complained to the hospital, which denied it had made any mistake. It also advised her against abortion as that could pose a risk to her.

Holding the hospital negligent in performing the surgery that gave Nirmala an unwanted child, Additional District Judge Kamini Lau slapped a fine of Rs.100,000 on it.

“Damages of the unwanted child may not be of any burden to an affluent family but in this case Nirmala and her husband are not financially sound to take the burden of the child,” the judge observed in her order.
