Don’t pass conflicting judgements, apex court tells judiciary

New Delhi : The Supreme Court Friday cautioned the higher judiciaries not to pass conflicting orders on a similar case as it would harm the justice delivery system.

“Increase in the frequency of conflicting judgements of the superior judiciary will do incalculable harm to the system inasmuch as the courts at the grassroots will not be able to decide as to which of the judgement lays down the correct law and which one should be followed,” a three-judge bench of Justices B.N. Aggrawal, H.S. Bedi and G.S. Singhvi observed.

The court passed the observation while allowing an appeal of the Official Liquidator challenging the directions passed by the Calcutta and Delhi high courts on the absorption of certain employees to Group ‘C’ posts on par with other government servants mainly on the principle of equal pay for equal work.

The two high courts had passed the directions despite several rulings being passed by the apex court and various high courts on similar issues, wherein it was held that there cannot be a blanket application of the principle of “equal pay for equal work” nor can the government be directed to absorb such employees.
