The appeal was admitted Wednesday.

A district court in July last year had released Tariq Ahmad Batloo for want of evidence.

Batloo had been arrested in 2006 and was booked under sections 122, 419 and 420 of the Indian Penal Code, Arms Act, sections 4 and 5 of the Explosive Substances Act and sections 165 and 175 of Indian Railways Act.

Police had claimed that Batloo had in his possession 1 kg of RDX, two Russian made hand grenades and two detonators when he was arrested in Goa, as he alighted from an Ernakulam-bound train at Margao railway station, 30 km from here.

Officials had then said that Batloo was a member of the Tehrik-e-Mujahiddin, which was an offshoot of the banned militant outfit Lashkar-e-Taiba.
