Court dismisses plea of disqualified DUSU candidates

New Delhi : The Delhi High Court Tuesday dismissed the petition of five candidates who had challenged their disqualification from the Delhi University Students Union (DUSU) elections, saying the Chief Election Officer had taken the decision in accordance with the rules.

Justice Sanjiv Khanna dismissed the plea of the five – Deepak Negi of the National Students’ Union of India (NSUI), Rohit Chahal of the Akhil Bharatiya Vidyarthi Parishad (ABVP) for the president’s post, Umesh Tomar (NSUI) for vice-president, Lalit Kumar (ABVP) for secretary, and Ashok Khare (ABVP) for joint secretary.

They had approached the court after they were disqualified by the university’s election officer.

The five were found spending more money than the fixed amount of Rs.5,000 each, using cars and organising rallies for their election campaigns which was against the former chief election commissioner J.M. Lyngdoh’s recommendations.

“I do not think that the principles of natural justice have been violated. The university had issued show cause notices to all the candidates before rejecting their candidature,” the judge ruled while dismissing the plea.

“The Chief Election Officer has rejected nominations of the petitioners at the time of scrutiny for violation of the code of conduct,” the court said.

In their petition, the ABVP candidates alleged the university has misinterpreted the recommendations and sought the court to restore their right to contest the elections.
