(a) to (d): The demand for grant of minority status to Jamia Millia Islamia, a Central University established under the Jamia Millia Islamia Act, 1988, has been received from various sections of the University community and society such as Jamia Teachers’ Association, Jamia Old Boys Association, Jamia Administrative Staff Association, Jamia Old Boys Union. A number of petitions in this regard are pending before the Hon’ble National Commission for Minority Educational Institutions.
The question regarding minority status of Aligarh Muslim University (AMU) is pending before a larger bench of the Hon’ble Supreme Court of India, where the interpretation of the term ‘establishing’ a University, as laid down in the ‘Azeez Basha’ matter, is under challenge. The judgment of the Hon’ble Supreme Court in the AMU matter will have a bearing on the issues relating to the minority character of Jamia Millia Islamia.

(a) to (b): Transport Department, GNCT of Delhi has entrusted “Travel Demand Forecast Study & Development of lntegrated Road cum Multi Model Public Transport Network for NCTD” to M/s RITES. Final report is yet to be submitted by M/s RITES. The study was targeted for completion on 30.04.2010.

(c): Delhi Police, however, has prepared a plan to tackle the situation in comprehensive manner in the NCT of Delhi, which is based on the principles of road safely education, regulation, enforcement and engineering solutions. Based on this, Delhi Police has taken a number of steps to decongest and streamline traffic in the NCT of Delhi. The details of the plan are as follows:
Increased presence of Traffic Police personnel in accident-prone areas. Facilitation at pedestrian crossings. Prosecution of two-wheelers. Increased pressure on Blue Line Buses. Decongestion of Bus lane. Prosecution against drunken driving and over-speeding. Installing Cats eye. Use of Public Address System. Prosecution of those travelling without Registration Certificates. Decongestion of Corridors from beggars and vagabonds. Strict prosecution of dumpers. Checking of Fitness Certificate. No Entry restrictions. Effective Night Checking.

(a) to (d) CGHS procures its requirement of generic medicines from Indian Medicines Pharmaceutical Corporation Limited (IMPCL), Ram Nagar. Proprietary medicines are procured from the manufacturer/distributor directly after the discount to be offered on the medicines is settled in advance. For procuring any non-proprietary medicines, not manufactured by IMPCL, the CGHS floats tenders at regular intervals of time. CGHS procures medicines at a time for three/six months, on the basis of the recommendation of the Purchase Advisory Committee Indent. For any medicine not available in stock, indent is placed centrally by the CGHS on the chemist, and the medicines are supplied directly to the dispensaries by the chemist.

Solar Photovoltaic Programme: Solar Street Lighting Systems : – Being deployed for Community street lighting in villages / predominantly scheduled caste/ minority populated villages/ institutions/ in urban areas of Local Bodies Solar Power Plants : – Being deployed in universities, hostels, mobiles towers, institutions, police stations, Primary Health Centers, etc. Micro Financing Programme: – Finance being made available to rural people through Regional Rural Banks (RRBs) for purchase of solar home lighting systems; Banks being incentivized for capacity building, awareness generation and other related activities. .
Solar Thermal Programme: – Solar Water Heaters (ETC / FPC type systems)- being deployed for domestic industrial, commercial, institutional use. – Solar Cookers: box and dish type – being promoted in market mode.
Remote Village Electrification Programme : Mainly solar home lights and solar street lights being deployed in un-electrified villages.
Energy Parks Programme: State Level Energy Park being developed at Zoo in Lucknow. District Level Energy Parks have been set up in different institutions at district level.
Electricity Generation from Biomass Programme: Biomass power/ Cogeneration plants/ Gasifier systems being installed in sugar mills, paper mills and other industries for meeting electricity and thermal energy needs
Aditya Solar Shops /Akshya Urja Shops Programme: Akshya Urja Shops: being set up in all the districts of the State for sale and service of all renewable energy devices and systems at the local level. The network of the shops is expanded by encouraging private entrepreneurs to setup and operate such shops.
Solar City Programme : Providing support to the Municipal Corporations for preparation and implementation of a Road Map to develop their cities as Solar Cities aimed at reducing projected total demand of conventional energy by minimum 10% at the end of five years through energy efficiency measures and renewable energy installations Agra and Moradabad have been taken up to be developed as Solar City.
Micro Hydel Programme: For power generation from the hydel potential at canal falls through private developers. 14 sites identified for setting up these projects.

STATEMENT REFERRED TO IN REPLY TO RAJYA SABHA STARRED QUESTION NO. 526 TO BE ANSWERED ON 3RD MAY, 2010 ASKED BY SHRI MOHAMMED ADEEB REGARDING WIDOWS AND ORPHANS IN J&K (a) to (c) As per 2001 Census there were 4.41% female widows in Jammu & Kashmir against the all India average of 6.0%. The figures are not collected for orphans in 2001 Census. However, a survey conducted by the Government of Jammu & Kashmir in 2007-08 indentified 6345 widows and 20708 orphans of civilians killed in militancy related violence. (a) The Government of Jammu & Kashmir, under the Integrated Social Security Scheme (ISSS) provides financial assistance in the form of pension at the rate of Rs. 200/- pm to widows having no source of income. This is in addition to the Indira Gandhi National Widow Pension scheme of Ministry of Rural Development under which Rs 325/- pm is provided. The State Rehabilitation Council is providing monthly pension @ Rs. 750 to widows of civilians killed in Jammu & Kashmir. One time financial assistance @ Rs. 10,000 is provided to BPL (Below Poverty Line) families in case of death of the primary bread winner. Apart from these, there are thirteen homes for destitute women which provide free boarding and lodging, medicines etc. Under the project ASSIST, the National Foundation for Communal Harmony provides financial assistance to orphan students from BPL families, including victims of terrorism/militancy related violence at the rate of Rs.800/- p.m. in Class A & B cities and Rs. 750 p.m. at other places upto the age of 18 years (extendable upto the age of 21 year in the exceptional cases). Besides, an amount of Rs. 150, in addition to the amount provided for general education, is also given to those pursuing professional education. The Government of J&K has opened 21 Bal Ashram with a total intake capacity of 1001 inmates where orphans children are provided free lodging, boarding, clothing, medicine, books etc.

(a) to (c): No, Sir. The Ministry provides financial assistance to the States for appointment of Urdu teachers in any locality where more than 25% of the population is Urdu speaking. This assistance is available for making new appointments as well as for existing Urdu teachers.

Under Sarva Shiksha Abhiyan, recognized Madarsas/Maktabs are eligible for additional teachers as per norms. Under Kasturba Gandhi Balika Vidyalayas (KGBV) Scheme, residential schools are set up at upper primary level for girls belonging to the SC, ST, OBC and minority communities. The States can also engage two Urdu Teachers in KGBVs in Blocks with Muslim population above 20% and in select urban areas.

The University Grants Commission (UGC) has also sanctioned Centres for Professional Development of Urdu Medium Teachers to the Maulana Azad National Urdu University, Jamia Milia Islamia and Aligarh Muslim University.

In addition, the Government has established a special University by an Act of Parliament called Maulana Azad National Urdu University in 1996 mainly to promote and develop Urdu language and to impart education in Urdu medium.

The NFADE has stated that experience over the last 12 years have proved that Prasar Bharati is not only financially unviable and could not achieve the concept with which it was set up. They also launched an agitation to press for their demands. Demands of NFADE have inter alia been included as an Agenda item for consideration of the newly constituted Group of Ministers on Prasar Bharati.

MINISTER OF DEFENCE

(a) A statement is attached.

(b) Election to only Meerut Cantonment Board out of the sixty two Cantonment Boards has not been held since the same was stayed by the Hon’ble Allahabad High Court vide its order dated 9.6.2008 in CMWP No.27630/2008.

(c) No, Sir. After the elected members of the Meerut Cantonment Board completed their term, the constitution of Cantonment Board, Meerut was varied under section 14 of the Cantonments Act, 1924 and a Board was constituted under section 14 of the Cantonments Act, 1924 on 3.3.2003 which functioned till 17.12.2006. After the Cantonments Act, 2006 came into force, the Board was constituted again on 18.12.2006 under section 13 of the Cantonments Act, 2006. This Board is functioning in the Meerut Cantonment ever since.

(d) Representations/requests have been received from various sources including some Hon’ble Members of Parliament for holding election to Meerut Cantonment Board. As per the requests made, election to Meerut Cantonment Board has been notified in the official Gazette on 25.3.2010 to be held on 13.6.2010 after the CMWP No.27630/2008 was dismissed by Hon’ble Allahabad High Court vide its order dated 27.1.2010.

(e) Cantonment Board, Meerut has already been constituted under section 13 of the Cantonments Act, 2006 on 18.12.2006.

DELAYED PROJECTS UNDER THE MINISTRY

(a) 56 projects of oil PSUs relating to Exploration & Production, Pipelines, Refinery upgradation, Liquefied Natural Gas and Liquefied Petroleum Gas are running behind the schedule.

(b) The main reasons for delay of these projects are:
i. Delay in acquiring of Right of Way (ROW) due to resistance by farmers. ii. Delay in award of contracts/packages iii. Delay in execution by contractors. iv. Slow progress of drilling of wells v. Delay in supply of equipment/packages by suppliers and local conditions at North East sites.

(c) Out of these 56 projects, only 12 projects have cost overrun. 33 projects have no cost overrun and 11 projects have cost underrun. Because of the magnitude of underrun in the cost of 11 projects, there is a net underrun in the cost of 56 delayed projects and time overrun in majority of the projects ranges from 1 month to 24 months.

(d) & (e) The projects are monitored by the Ministry as well as Oil PSUs on regular basis and remedial action are taken thereon, wherever necessary.

(a) the details of the firms/companies and organizations from which medicines, drugs and raw products are being procured by the Central Council for Research in Unani Medicine (CCRUM):

(b) what are the credentials of such firms/companies and organizations;

(c) whether it is a fact that arrangements with some of these firms/companies and organizations are irregular and in violation of laid down procedure and provisions;

(d) the details of those from whom such articles are being procured without calling for tender; and

(e) the steps being taken to order a comprehensive inquiry into this?

(a) & (b) Central Council for Research in Unani Medicine (CCRUM) has been getting its requirement of drugs from its own pharmacy at Central Research Institute of Unani Medicine (CRIUM), Hyderabad. No Medicine is procured from outside, except a few compound drugs which are procured on the basis of CGHS rates.
35 Kit Medicines are, however, being got manufactured on the basis of comparative rates from the firms having Good Manufacturing Practice (GMP) certificates and registered and licensed with National Research Development Corporation (NRDC) with whom the Council is having MOU for getting patent rights of the drugs. Firms presently manufacturing the drugs are : -M/s Maxo Laboratories , Delhi -M/s Herbs and Herbs, Jaipur -M/s Drug Laboratories, Meerut Each firm is accredited having registered with NRDC and GMP compliance.

(c) to (e) It has been reported by the CCRUM that no procurement is being made without following the process of tenders, except in the case of Indian Medicine Pharmaceutical Corporation Limited (IMPCL) as well as registered Units of the Khadi & Village Industries Commission (KVIC). Instructions have been issued recently for finalizing rates for procurement of crude drugs also on the basis of lowest rates after due issue of tender notice in order to streamline the System. However, to rule out the possibility of any irregularity, the Chief Vigilance Officer (CVO) of the Department of AYUSH has been asked to look into the complaints, if any.

(a) to (c): The details of the ongoing thermal and hydro power generation projects which are running behind schedule, the reasons for delay, and time and cost overruns are given in Annex–I & II respectively.

(d) to (e): Some of the steps taken by the Government to ensure that power projects are commissioned as per the schedule during the Eleventh Five Year Plan are as follows:
– Monitoring mechanism in the Ministry has been strengthened. The progress of generation projects targeted for completion during the 11th Five Year Plan is reviewed intensively in periodical meetings by the Central Electricity Authority, Ministry of Power and Power Projects Monitoring Panel (PPMP). An Advisory Group under the Chairmanship of Hon`ble Minister of Power has been set up to suggest ways and means to achieve the 11th Plan capacity addition targets.
– Inadequate manufacturing capacity was recognized as one of the major reasons for slippages during the 10th Plan. Accordingly, the issue of inadequate manufacturing capacity was taken up with Ministry of Heavy Industry/ BHEL at various fora. As a result, BHEL have taken up capacity augmentation programme to increase their capacity (Thermal + Hydro + Nuclear) to 15,000 MW/ annum by March, 2010 and upto 20, 000 MW by March` 2012 depending upon market conditions.
– M/s L&T has already formed a Joint Venture Company with MHI, Japan for manufacture of supercritical steam generator and steam turbine generators in India.
– All stakeholders have been sensitized towards enlarging the vendor base so as to meet the Balance of Plants (BoP) requirements.
– Bulk ordering of 11 units of 660 MW each with supercritical technology with mandatory phased indigenous manufacturing Programme is also planned to promote indigenous manufacturing.
– Periodical meetings are held with concerned Ministries viz. Ministry of Coal, Ministry of Petroleum and Natural Gas and Ministry of Environment & Forests and at other forums at highest level to sort out the Inter Ministerial issues with regard to availability of fuel and grant of Environment & Forest clearance to generation projects.
– In addition to this, to ensure that the capacity addition targets are realized and projects are commissioned as per schedule, an Accountability System has been put in place for XI Plan Central Sector power projects scheduled for commissioning during the Eleventh Five Year Plan period.

An amount of Rs. 1243.78 crore has already been released for implementation of this programme in minority concentration districts.

(c ) The scheme of MsDP has a monitoring mechanism for regular review at different levels in district, State/UT and Centre. The State and district level committees for Prime Minister’s New 15 Point Programme for the Welfare of Minorities also serve as the State and district level committees for MsDP. The programme is also reviewed by an Oversight Committee at the Centre and the State Government/UT administration.

The Land & Development Office (L&DO), Ministry of Urban Development has informed that there are 61 properties existing on its land. Details of these lands are at Annexure. Based on a decision taken in 1984, the Government had decided to transfer these properties to Wakf Board and sanction had also been conveyed accordingly. But the transfer was challenged in WP (C) No.1512/1984 titled Indraprastha Vishwa Hindu Parishad Vs Union of India in the Delhi High Court. The Delhi High Court has ordered to maintain status quo due to which the property could not be transferred. Matter is now sub-judice.

(d): No such time frame can be indicated in view of reply above.

(a) In order to popularize its schemes, National Minorities Development and Finance Corporation

(NMDFC) has been organizing awareness programmes through its State Channelising Agencies (SCAs). Besides, pamphlets and brochures have been printed and distributed in Hindi, Urdu and English by NMDFC. The SCAs have also been publicising scheme guidelines in the regional languages.

(b) and (c) National Minorities Development and Finance Corporation (NMDFC) releases funds to the State Channelizing Agencies (SCAs) for onward lending to the eligible beneficiaries belonging to minority communities in a State. In this connection, the SCAs / State Governments must meet conditions like availability of guarantee of State Government, equity contribution of State Government, timely repayment of loans and satisfactory utilization of funds disbursed in the past etc. Eligible persons of minority communities in those States which have not received adequate funds from NMDFC on account of non-fulfillment of conditions by the SCAs / State Governments are unable to adequately avail the benefits under the schemes of NMDFC. Such States are regularly advised to remove the impediments for enabling release of funds by NMDFC to the SCAs for carrying out lending activities.

(d) NMDFC regularly liaises with State Governments / SCAs to ensure that funds from NMDFC are drawn so that loans can be extended to the target groups.

The posts falling vacant in Branch Post Office are filled up immediately either by regular appointments or redeployment from other offices or by making substitute arrangements.

AVAILABILITY OF PETROLEUM PRODUCTS IN RURAL AREAS .

(a) the steps taken so far to make Liquefied Petroleum Gas (LPG), Compressed Natural Gas (CNG), petrol and diesel available in rural areas ;

(b) the details of rural areas covered thereunder during the last two years and the current year ; and

(a) to (c) : Public Sector Oil Marketing Companies (OMCs) namely, Indian Oil Corporation Limited (IOC), Bharat Petroleum Corporation Limited (BPCL) and Hindustan Petroleum Corporation Limited (HPCL) have freedom to set up LPG distributors/ Retail Outlet (RO) dealerships as per their commercial consideration based on feasibility and economic viability of the locations as per their own guidelines, which are available on the websites of the concerned OMCs as well as at their Regional/State Offices.

As per the “Vision 2015” adopted for LPG sector, a target has been given to the OMCs to raise the over-all LPG population coverage to 75% in the country by releasing 5.5 crore new LPG connections by 2015 especially in rural areas and uncovered areas and also examine the possibility of providing more Retail Outlet/Kisan Seva Kendra (KSK).
In order to increase rural penetration and to cover remote as well as low potential areas, a new scheme namely, “Rajiv Gandhi Gramin LPG Vitrak Yojana” (RGGLVY) for establishing small size LPG distribution agencies for locations having potential of 600 or more refill sales per month has been formulated.
The scheme has been launched on 16.10.2009 and subsequently advertisement inviting applications for distributors under the scheme have been released by OMCs in 8 States where the reach of LPG is very low namely, Bihar, Chhatisgarh, Jharkhand, Madhya Pradesh, Orissa, Rajasthan, Uttar Pradesh and West Bengal covering 1266 locations.
The setting up of LPG distributors under this scheme will now be a continuous process till all parts of the country deficient in LPG were covered by LPG network.
During the year 2007-08, 2008-09 and between April and December 2009, OMCs have commissioned 325 LPG distributors and 3250 ROs including 1866 KSKs in the country.
As regards CNG agencies, Government is taking multi-pronged steps to increase the availability of natural gas in the country. Further, Government is undertaking efforts to ensure development of natural gas transportation infrastructure. Petroleum & Natural Gas Regulatory Board (PNGRB) has been set up to encourage investment in natural gas transportation infrastructure and City Gas Distribution projects.

(a) to (c) There are only five dispensaries/units under CGHS, Delhi which offers treatment to CGHS beneficiaries under Unani system of medicine. In view of the fewer number of beneficiaries opting for treatment under Unani system of medicine, CGHS has designated only one chemist for supply of medicines on local purchase basis, which is done centrally and the medicines are supplied directly to the concerned dispensary/unit by the chemist. This takes a little longer, in some cases, than the time taken for receipt of allopathic medicines. The position is likely to improve after all Unani dispensaries/units are computerised and connected through network.

(a)to(c): The post of Adviser (Unani) in the Department of AYUSH has been vacant since 02.12.2006, after the repatriation of the incumbent officer on expiry of his contractual appointment. In the meantime, the Department initiated action to amend the Recruitment Rules for the said post for providing for a composite method of selection, with a view to widen the scope of the selection, in consultation with Department of Personnel & Training (DoPT) and the Union Public Service Commission (UPSC). This process including consultation with the UPSC took some time. However, keeping in view the legal position, it was decided that the existing vacancy should be filled up as per the existing Recruitment Rules and action for the proposed amendment of the Rules will be taken thereafter.
A proposal was moved on 3rd September, 2009, to UPSC for recommending a suitable departmental candidate for the said post by promotion as per the first option of the existing Recruitment Rules. The Departmental Promotion Committee (DPC) met on 21st December, 2009 and found none of the serving departmental candidates in the zone of consideration as ‘fit’ for promotion to the post of Adviser (Unani). Thereafter, action has been taken for advertising for filling up the post by ‘deputation including short term contract’ as per the second option of the existing Recruitment Rules.

For specified purposes term loan of a maximum of Rs. 5.0 Lakhs is available to individuals at the rate of 6% interest per annum and micro- credit of a maximum of Rs. 25,000 per member is extended to the members of Self Help Groups (SHGs) at an interest rate of 5% per annum. The schemes of NMDFC are being implemented through State Channelising Agencies and Non-Governmental Organizations. Further details of the schemes of NMDFC are placed at NMDFC`s website www.nmdfc.org

(a): The Government of National Capital Territory of Delhi (GNCTD) has informed that no formal orders regularizing unauthorized colony has been issued by it so far pursuant to the revised Guidelines of 2007 and Regulations issued by DDA in 2008.

(b): GNCTD has informed that Resident Welfare Associations (RWAs) of 1639 unauthorized colonies have applied for regularization.

(c): Yes, Sir.

(d) & (e): Regularization of unauthorized colonies will inter-alia involve scrutiny of layout plans, assessment of built up percentage as on 31.3.2002, identification of mixed land use streets, approval of layout plans, fixation of boundaries, land use change, identification of colonies not eligible for regularization etc. Scrutiny of documents submitted by the RWAs has been initiated and Municipal Corporation of Delhi (MCD) has conducted camps with RWAs. Guru Gobind Singh Indraprastha University has superimposed the boundaries of layout plans of satellite /aerial survey images in respect of large number of colonies. Large number of maps have been provided by GNCTD to MCD. The progress is being monitored by GNCTD. As per the revised Guidelines of 2007 and Regulations of 2008, the work relating to regularization involving agencies concerned is to be undertaken, co-ordinated, monitored and supervised by GNCTD.

The State Governments have been advised to consider requests for extension of area validity on merits based on the recommendations of the District Magistrate concerned, keeping in view the law and order situation obtaining in the district/state and other local factors. With reference to the said instructions, Government of National Capital Territory (GNCT) of Delhi, with the approval of Lt. Governor, GNCT of Delhi framed guidelines on 06.08.2009 for considering requests for extension of area validity of arms licenses for NPB weapons. Thus, the Government of NCT of Delhi are competent to frame guidelines to decide request for extension of area validity of NPB arms licenses.

During the 10th Plan period, Ministry of Tourism has sanctioned tourism projects including infrastructure projects and fairs & festivals for Rs.9726.61 lakh to the State Government of Uttar Pradesh at various places, proposals of which have been received from the State Government.

(a)to(c )The latest Fact Sheet No. 304 of May, 2006, of world Health Organisation (WHO) states that “Considering the very low exposures levels and research results collected to date, there is no convincing scientific evidence that the weak RF signals from base stations and wireless networks cause adverse health effects”. Further, a committee was setup under the Director General, Indian Council of Medical Research (ICMR), as per the orders of Hon’ble High Court, Mumbai, to study the effects of radiations from mobile phone towers and related aspects. The Committee had studied the effects and concluded that “overall there is not enough evidence to show direct health hazards of RF exposures from Mobile Base Stations”.

In regard of the Structural safety, before erection of any cell tower, it is mandatory to obtain Structural stability certificate from one of the institute in Delhi/NCR:-

(a) Indian Institute of Technology (IIT) Delhi.

The Department of Commerce released Rs.62.58 crore during 2007-08 and Rs. 20.58 crore during 2008-09.

2. Human Resource Development (HRD) under Indian Leather Development Programme (ILDP): During the year 2008-09, Rs. 4 crore have been released to the implementing Agency “Footwear Design & Development Institute (FDDI), Noida” for conducting training programmes at Kanpur, Agra and other on-site training programmes under the sub scheme.

3. Establishment and upgradaton of Workshops, Labs and Classrooms at FDDI, Noida: The amount released was Rs. 2 crore in 2007-08 and Rs. 5 crore in 2008-09.

4. Integrated Development of Leather Sector (IDLS): Under this scheme, DIPP has approved assistance of Rs. 15.40 crore during 2007-08 and Rs.9.15 crore during 2008-09 in Uttar Pradesh.

5. Establishment of information Technology Centre (ITSC) and Construction of Hostel at FDDI, Noida: The amount released to UP was Rs. 0.42 crore during 2008-09 and Rs. 16.74 crore during 2009-10. 6. Assistance to States for Infrastructure Development of Export (ASIDE): The amount released to UP under the State component of the scheme was Rs. 23.10 crore during 2007-08 and Rs. 22.10 crore during 2008-09.

OMCs have reported that they have planned to set up 624 LPG distributors and 860 ROs (except HPCL) in the country including 51 LPG distributors and 69 ROs (except HPCL) in the State of Uttar Pradesh during the year 2010-11.

(a) the details of the areas covered under the Central Government Health Scheme (CGHS) allopathic dispensary at Sriniwaspuri, Delhi;

(b) whether it is a fact that this dispensary covers a large area and the beneficiaries have to commute long distances and spend upto four hours to avail the facility; and

(c) if so, what steps are being taken to open more CGHS dispensaries to reduce the burden on this dispensary and to provide facilities to CGHS beneficiaries at some more convenient places?

(a) to (c) Sriniwaspuri dispensary of the CGHS in Delhi covers the following areas: “Area known as Srinivaspuri and Block No. IV, L.M.V.O.P. & Q of Double Storey Quarters of Lajpat Nagar and Colonies known as Nehru Nagar, Daya Nand Colony, Hindustan Housing Factory, Jeewan Nagar, Maharani Bagh, Kalandi Colony, Friends Colony, Hari Nagar Ashram, Kilokri Village, D.E.S.U. Colony, Ramesh Colony, Ishwar Nagar, Sunlight Colony, Sunlight Estate, East of Kailash, Railway Station on Okhla, Village Tamur Nagar, Bharat Nagar, Okhla Tank, Harkesh Nagar, Okhla Villalge Adbul Fazal Enclave, Zakir Nagar, Batha House, Noor Zakir Nagar Extension, Okhla, Nandpur Khadar, C.R.R.I. The areas covered by Srinivaspuri dispensary are mostly colonies which are private colonies and CGHS beneficiaries are so scattered that it is not possible to set up dispensaries within easy reach of all beneficiaries within the exiting infrastructure and resources presently available to CGHS.

(b) the details of action taken in each of these cases ;

(c) whether it is a fact that inspite of these complaints malpractices and irregularities are continuing unabated in these companies ; and

(d) if so, the steps being taken to prevent recurrence thereof ?

STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (d) OF THE RAJYA SABHA STARRED QUESTION NO. 1 BY SHRI MOHAMMED ADEEB TO BE ANSWERED ON 23RD FEBRUARY, 2010 REGARDING COMPLAINTS AGAINST OIL MARKETING COMPANIES.

(a) to (d) : It is the endeavour of Public Sector Oil Marketing Companies (OMCs) to provide complaint free service to customers. However, in the process of supplying refill to 11.3 crore LPG consumers, some complaints are received. OMCs have reported that based on the established complaints for various irregularities, action has been taken in 2547 cases including termination of 74 distributors in the country during the year 2008-2009 and between April and December, 2009 under the provisions of MDG / Distributorship Agreement. An amount of Rs. 1727.17 lacs has been imposed as penalty on the erring LPG distributors under the provision of MDG during the same period. The year-wise and company-wise details are as under :-

(upto December, 2009) 304 4 485.12 TOTAL 2547 74 1727.17 Surprise Quality Control Checks which includes weighment of cylinders are carried out at the distributor godowns and weight checking of filled cylinders in transit is being done by the field officers to check pilferage/presence of any underweight cylinders. The distributors have also been instructed to satisfy the customers about the correct weight of cylinders by weighing them, to ensure that the seals are verified & shown to the customers at the time of delivery. In case any under-weight cylinder is received by the customer, such cylinders are replaced free of charge by the OMCs. Industry has also invited a Global Expression of Interest for development of an Anti Pilferage Device.
Government has enacted “Liquefied Petroleum Gas (Regulation of Supply and Distribution) Order, 2000” and formulated “Marketing Discipline Guidelines, 2001” which provides for penal action against erring LPG distributors. Accordingly, MDG, 2001 were issued and made effective from 12.04.2001 to take action against erring distributors for serious malpractices like diversion of domestic LPG cylinder for non-domestic use, recovery of unauthorized charges from customers, supply of underweight cylinders, etc.
MDG , 2001 provides inter-alia following action against erring LPG distributors for major offences :

– Fine of Rs. 20,000 plus the price of LPG diverted at commercial rates for 1st offence. – Fine of Rs. 50,000 plus the price of LPG diverted at commercial rates for 2nd offence. – Termination of the distributorship for 3rd offence.
In addition to the action taken by the OMCs, State Governments are also empowered to take action under the LPG (Regulation of Supply & Distribution) Order, 2000. Similarly, the Weights and Measures Departments of the States / UTs initiate legal action against those LPG distributors found supplying under-weight LPG cylinders.
