The former minister has also sought the quashing of a lower court order rejecting his plea.

Justice R.H. Shukla admitted the matter and posted it for hearing Oct 22, after issuing notices to the state government and the CBI.

Shah, an accused in the Sheikh staged shootout case, filed the petition in the high court Monday.

In his petition, he challenged the special CBI Judge G.K. Upadhyay’s Oct 8 order refusing to grant him bail on grounds that Shah may tamper with the evidence and pressurize witnesses by using his political clout.

Shah was arrested by the CBI July 25 in connection with the killing of Sheikh and the mysterious death of his wife Kauserbi.

The Gujarat Anti-Terrorism Squad (ATS) has been accused of killing Sheikh in a staged shootout Nov 26, 2005, in Ahmedabad. His wife is suspected to have been killed at a farm near the city two days later.

Over a dozen policemen, including Indian Police Service officers, have been arrested for the killings.
