The petition has been filed by a local lawyer Ashok Pandey. He challenged the appointment on the ground that a judge who has been serving as a Justice cannot be the Chief Justice of the same High Court. Justice Alam has been a regular Justice at Lucknow for past 15 years. For a brief period he was transferred to Bihar, his home state, as a judge in the Patna High Court but he was soon transferred to Lucknow Bench of High Court.
