The request to withdraw appeal was considered by the Division Bench comprising of Js J Chelameswar and PR Ramachandra Menon. The UDF government had approached the court reportedly citing the social problems involved in the case as well as the present circumstances.

Two persons were killed in the clashes that took place on November 15, 2009, in Kasargod when a public meeting of the Muslim League was being held to welcome the new state president Panakkad Syed Hyderali Shihab Thangal and other state leaders. One person named Shafeeq was killed in police firing and the other named Muhammed Azhar was stabbed to death. Both were reportedly members of the Muslim League.

Meanwhile, the Kasargod district committee of the Muslim League said in a statement that Shafeeq was shot at without any provocations during the public meeting. Shafeeq was killed by the bullet from Kasargod SP around 200 metres away from the stage. Shafeeq’s father approached the High Court when the case was not being investigated well. The court ruled that the case should be transferred to the CBI and the family of Shafeeq be given compensation by the state government. The LDF government then appealed against the order of the High Court Single Bench. When the UDF government came to power, it decided to withdraw that appeal, said the statement.

The order of the Single Bench came on September 24, 2010, in the petition filed by Musthafa Haji, father of Shafeeq. The High Court had then ordered for CBI probe and to give compensation amount of Rs 5 lakhs to the family of Shafeeq.
