Ghaziabad : In the Aarushi-Hemraj double murder case, the defence Wednesday claimed in a court here that a doctor presented by the CBI as a witness was not reliable.
Doctor Sunil Kumar Dohre, who conducted the post-mortem on Aarushi, was cross- examined by the defence before Central Bureau of Investigation (CBI) Special Judge S. Lal.
The defence alleged that the CBI witness was unreliable because there were variations in his statement before the probe agency and the statement in court.
The court would next hear the case July 31.
Defence lawyer Manoj Shishodia claimed that Dohre, who mentioned that no abnormality was detected in the genital condition of the victim, said in his testimony in court that the victim’s vaginal portion was abnormal in size.
After the questions from the defence, the doctor admitted that it was an error.
In the post mortem report, the doctor did not mention which weapon was used in the crime, the defence said.
But an eight-member team of doctors, including Dohre, later observed that a khukri, a curved knife, could have been used in the crime, the defence said.
When the CBI later insisted whether the wound could have been inflicted with a golf club, the doctor said that since a golf club was also a blunt weapon it could have been the weapon of offence.
Aarushi, 14, was found murdered at her parents’ Noida residence May 16, 2008. The body of the family’s domestic help Hemraj was found the next day on the terrace of the house.
The CBI special court has framed charges against the Aarushi’s parents — Rajesh and Nupur — in the double murder case.
The court charged the Talwars under sections 302/34 (murder with common intention) and 201 (destruction of evidence with common intention) of the Indian Penal Code (IPC).
In addition, the court charged Rajesh Talwar under section 203 (giving false information in respect of an offence committed) of the IPC.
Nupur Talwar was taken into custody April 30 and is lodged in Dasna jail in Ghaziabad district since then. She has challenged in the Supreme Court the May 31 Allahabad High Court order rejecting her plea for bail.
