IM suspects property attached, family left homeless, Jamiat comes in support

Mumbai/Pune: Although it is the established procedure of the law that no person will have to bear the burden of crime done by other person but it is not always true for the investigative agency in India. In a trivial move National Investigation Agency (NIA) has obtained orders from special NIA court Delhi to attach property in Pune of allegedly absconding Indian Mujahideen operative Mohsin Chaudhary. It is noteworthy that Mohsin Chaudhary has been allegedly absconding since last 5 years but the investigation agency has acted now for attaching his property. Mohsin chaudhary’s family is into the denial and claims that the property does not belong to Mohsin but to his father in law.

Jamiat Ulema has strongly condemned the move of attaching Mohsin Chaudhary’s property, especially his house ‘Manisha Complex’ Kondhwa Khurd-Pune, where his family was residing till now. Jamiat Ulema has immediately approached the special NIA court in Delhi to cancel such order on the ground that the property in question does not belong to Mohsin Chaudhary but to his father in law.

Jamiat Ulema said that their office received a phone call from Pune at around 12.00 pm informing that the family of Mohsin Chaudhary, including his children and aged parents, have been moved out of their house and NIA was sealing their house due to the orders issued by special NIA court, Delhi.

Jamiat advocate Nadeem Ansari said, “The court should have given family a prior notice so that they could have informed the court about actual ownership of the property “. He also said, “Jamiat have decided to raise the issue before court and to support the family which has left homeless now”.

Gulzar Azmi, Secretary of Jamiat Ulema Legal cell said, “I called up Ismail Chaudhary and inquired about the property documents and he informed me that the house does not belong to Mohsin but to his father-in-law”.

After getting confirmation Jamiat Ulema immediately called their senior advocate M.S. Khan in Delhi and asked him to raise the issue before special NIA court. Advocate MS Khan then filed an application before special NIA judge I S Mehta and prayed to cancel the orders of attaching of the property in question because it does not belong to Mohsin Chaudhary. He also requested court to immediately decide the application so that Mohsin’s aged parents and small children who are left homeless will not have to spend their night on the streets. The application is expected to be taken up by court shortly.

Investigation agency has accused Mohsin Chaudhary to be an active member of IM who allegedly crossed over to Pakistan along with Riyaz and Iqbal Bhatkal in 2009. Mohsin Chaudhary has been shown as an absconding accused in Gujarat 2008 blasts, Mumbai email case and German Bakery blast.

Mohsin’s brother Akbar Chaudhary was arrested by Mumbai crime branch in 2008 when they busted alleged IM module in Pune . He was made accused in Mumbai threatening email case, Gujarat 2008 Blast case, Gokul Chat blast case in Hyderabad and Delhi 2008 blast case.
