New Delhi : A court here Wednesday pulled up Delhi Police while seeking clarification on whether any fresh evidence has emerged against Lashkar-e-Taiba (LeT) bomb expert Abdul Karim Tunda over a 1994 case pertaining to recovery of explosive substances.
Tunda was Tuesday charge sheeted in the case under the Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Explosive Substances Act.
Additional Sessions Judge Bharat Parashar asked police to clarify whether any fresh evidence has emerged against Tunda while observing that earlier all other accused, arrested in this case, were acquitted of TADA charges.
The court questioned why should one go on a futile exercise and said: “If the evidence is the same and the judgment has attained finality, I cannot do anything.”
The court listed the matter for Feb 18 after the prosecution sought more time.
Police had earlier taken Tunda in their custody to quiz him in connection with the case. He was declared a proclaimed offender in the case of recovery of explosive substances registered at south Delhi’s Malviya Nagar police station in 1994.
Police also said some accused were arrested Jan 17, 1994, and 150 kg explosives and six daggers were recovered from them.
According to police, Tunda is involved in 33 bomb blasts in India between 1994 and 1998, 22 of those in Delhi.
The police arrested Tunda Aug 16, 2013, from the Banbasa area of Uttarakhand near the Indo-Nepal border. Tunda, however, has claimed he was not arrested in India but picked up from Nepal.
