Ma’dani’s anticipatory bail petition to be considered today

Bengaluru: The anticipatory bail petition submitted by Abdunnasir Ma’dani in connection with the Bengaluru blast case will be considered today at 3 pm. The case was considered early today but the judge did not take a decision and postponed it to 3 pm.

When considered early today, the prosecution argued that anticipatory bail should not allowed as charges against Ma’dani included acting against the country. Ma’dani’s advocate argued that he be given anticipatory bail as he was a famous politician besides being handicapped. The case was postponed to today by the Bengaluru fast track sessions court judge according to the request of the prosecution when it was considered last Saturday.

Meanwhile, the time-limit of the non-bailable arrest warrant issued by the Additional Chief Metropolitan Magistrate court against Ma’dani ends tomorrow. Ma’dani’s anticipatory bail petition would go invalid if it is again postponed today and the non-bailable arrest warrant is executed within the stipulated time. However, the police may approach the court to renew the warrant if they do not execute it within the time limit.

The Kerala Muslim Samyuktha Vedi (a common forum of Kerala Muslims) organized a march to the Secretariat and dharna in the state capital yesterday. Veteran journalist BRP Bhasker who inaugurated the dharna said that the conspiracy against Ma’dani was not a problem of PDP and the Muslim community alone, but rather the problem of the Kerala society which yearns for justice. Central minister Mullappally Ramachandran is saying to Ma’dani, who spent 10 years in Coimbatore jail for a crime that he didn’t do, that he won’t have to suffer punishment if he is not guilty. It is true that there are terrorist activities going on in the country. He condemned the moves to book the Muslim community concealing the revealed fact that the Hindu terrorists were behind several terrorist acts.

BSP leader Neelalohithadasan Nadar said that the problem of Ma’dani, who upholds the problems of Dalits, is a problem of the Dalit community also. The Kerala society shoul be ready to respond considering the matter as a human rights problem, opined Sheikh Muhammed Karakunnu, assistant Amir of the state Jamat e Islami. He added that central minister Mullappally was dutiful to explain his views regarding the torture of Muslims in terrorist cases which were proved they had no role in. Journalist critic Bha Surendra Babu said that the state would like to know the present views of Chief Minister VS Achuthanandan and Opposition Leader Oommen Chandy who had been to Tamil Nadu for Ma’dani languishing unreasonably in jail.

In another development, Muslim League general secretary PK Kunhalikkutty yesterday explained the party policy that the law should take its course if Ma’dani is guilty and he should not be punished if innocent.

Ma’dani is the 31st accused in the Bengaluru blast case. He pleads innocence and alleges that the Intelligence Bureau was trying to trap him. He doubted that once he was caught he would be named even the first accused. The fasting satyagraha launched by the PDP has completed six days. Major leaders of Muslim, Dalit organizations as well as human rights activists continue to visit the satyagrahis and Ma’dani and express solidarity with the struggle for justice.

There are reports that the chargesheet includes Ma’dani’s brother, father and wife speaking witness against Ma’dani which establishes Ma’dani’s connections with Thadiyantavide Naseer, the prime accused in the blast case. The chargesheet also reportedly claims Thadiyantavide Naseer to be the founder of the Silsila Noori-sha Thareeqath. Naseer founded the Thareeqath faction inspired by the books given by Ma’dani.

Among the 32 persons accused in the case, 16 are already under police custody in different states. Twelve people including Ma’dani are yet to be arrested. Two persons to be arrested are Pakistani nationals and one is from Oman. Four persons, those accused from 12th to 15th, were killed in encounter in Kashmir. Only Ma’dani has tried for anticipatory bail. Riyas Bhatkal is reportedly absconding for a few years.
