Vietnam Issues New Regulation For Employing Foreign Workers

Hanoi : The Vietnamese government has issued new regulation – Decrees No 34/2008/QD-CP on recruitment and employment of foreign workers.

Foreign workers must be 18 years of age or older and meet health, skills and certification requirements, the Vietnam news agency (VNA) reported Wednesday.

However, excluding a few cases, they must have work permits issued by Vietnamese authorities.

The regulation on work permits has also been expanded to cover foreign workers who are referred between affiliate companies, or who come to Vietnam to work under service agreements, all of whom are now subject to work permit requirements.

Twenty percent of the managers and directors of a company which accepts foreign workers transferred from a parent company or affiliate must be Vietnamese. Such companies must comply with the three-percent limit on foreign workers.

Foreigners who came to Vietnam to offer services to Vietnamese companies and individuals must notify authorities, the government said.
